There is no changing of the visa. At POE they will grant you immigrant status with conditions if you have been married less then two years - two year green card. If on entry you have been married two years or more you will be granted immigrant status without conditions - 10 year green card. You do however have to bring it the officers attention at Port of Entry when you are going through immigration if you have been married two years or more on entry, so as the correct status will be granted. Otherwise it can be a pain in the butt to correct later.

:help:

Do I need to have my spouse meet me at the terminal when I get off the plane in case I have a problem with customs or in case I need to speak with him? I say this because I most likely will be taking a flight with a stop in a different city before my final destination, and if that is not the case I happen to know that the final destination has a tram that connects the flight gates to the rest of the airport and unless you have a ticket they of course will not permit anyone to enter that part of the airport (thanks to terrorism problems). Thank you

P.S. Is it possible that I lose my next flight because of the paperwork they have to check in the brown envelope. If so, can I take another flight if I lose mine?

Another thing, should I get the removal of the temporary visa after I get to the U.S or after the second year of marriage ? or does it have to be before the second year of marriage because I read in one of the sites that one of you sent me that I have to do this removal of papers before the second marriage anniversary.

This is what I read in an official page from the embassy: :reading:

F:\remove conditions visa.htm

You and your spouse must apply together to remove the conditions on your residence. You should apply during the 90 days before your second anniversary as a conditional resident. The expiration date on your alien registration card (commonly know as green card) is also the date of your second anniversary as a conditional resident. If you do not apply to remove the conditions in time, you could lose your conditional resident status and be removed from the country.

Thank you (F):help:

No your spouse does not have to be with you when you go through immigration and unless he is travelling with you, an impossibility. Have a read of the POE Drill which has experiences from members.

Whether or not you are able to get another flight is dependant on the airline and in most cases probably not. Best to make sure you allow yourself a mininum of 3 hours between flights. You can check with others for information on particular Ports of Entry as some may require a longer layover in order to get through immigration and customs.

Just as the information states, you apply to remove conditions 90 days prior to the two year anniversary of you entering the US. It is up to you to remember this as you wont receive anything official to remind you.

hi Ingrid,

No, your spouse isn't required to meet you, and I think you will not find the entry process too hard on your own.

While it IS possible that you coiuld be delayed long enough to miss your connecting flight, that rarely happens unless you are booked too close together. If you have 2 or more hours, you *should* be OK. If something happens and you are late, the airline will help you re-book your flight.

When you finish in immigration, and pick up your bags from Customs, go through the Customs check. Right outside that, there shouild be a place for you to "re-check" your bags, and there will be airline workers there. Look for the right flavor (the airline you will fly next) and ask them for direction. They'll be nice. :)

About the next step, do not be confused with the word 'anniversary'. They do not mean your marriage anniversary, as you can see when you closely read the instructions from the Consulate. Two years *after you enter the US* (that is when you become a Permanent Resident) is when you need to file. You don't have to do anything official for the first two years.

Make sure you understand, and ask if you don't--we will try to word things better. :)

I don't know, some people just don't go for K-3 at all. I believe they do wrong because its not a lot of hassle, even if it is, obviously you are doing it to bring your spouse in who you love the most. Secondly, you never know with the authorities that what may come up, unexpected circumstances are not very rare when you are dealing with immigration. Again, filling for K-3 doesn't hurt at all and its just $170. At the end of the day, you don't want to regret that you didn't file for K-3. I would say, file both and just keep a track, even if K-3 doesn't work out, you would say $170 gone to waste and a little bit of hassle but hey, you are better off in that position then have nothing in hand and wait more and more for CR-1 to be processed.

Spouse don't need to be present at the consulate but if he/she wishes to, no one refuses. I believe that US Embassy anywhere does not refuse entry into the consulate for any USC if he/she passes through the security procedures at the gate or the entrance.

I hope that helps a little bit.

You are not eligible to sponsor your parents to come to the US to live until you are a US citizen. This can be 3-4 years after you come to the US with your immigrant visa. If you are interested in becoming a US citizen, I encourage you to start researching the process now so that you do the things that will be required of you and have no delays.

I'm glad you understand the Removing of Conditions (make sure your US husband does too!). You will file that form together after you have been IN the US for about 2 years.
