Less riskier? CR1. Would majority take that route, if they had another tempting and more comfortable, albeit not totally by-the-book option available.. Who knows. No one can take that risk for you, so ultimately, it is up to you to decide. I'm sure other people will pitch in soon, and you can always just poll it and go with majority vote.. I wouldn't though It's not our relationship and future marriage on the line.. Which is why I keep saying that you need to decide for yourselves.

Does the J1 visa have a home residency requirement? It would be printed on the visa itself.

I swear I must be missing something in this thread. Yes, we all know intent is not a sufficient reason to deny AOS. But they're facing misrepresentation here too. He appears to have gotten the J-1 with full intentions of coming to get married and stay permanently. I'm betting he didn't disclose that at the visa interview.

The J visa is well-known amongst young people in Ireland as a way to come to the US. Throughout the last 20 years or so, there have been several programs created by the State Department specifically for Irish Citizens. Here is information on the most recent program:

My own husband visited the US 21 years ago on a J visa.

I doubt fraud or short cutting the system was on this young man's mind.
