i don't know what is a "dry run" but the joint sponsor meet the requirements by far.

Hi everybody,

I update that topic cause we have been approved (NOA2) and it's now time to prepare the affidavit of support.

But I still don't know how to file it cause of that joint sponsor thing.

I resume, my wife have not enough income to sponsor me, so her uncle's gonna be the joint sponsor.

Usually he's claiming 3 of his nephews on his taxes (their parents are unemployed both) and file as "head of houdehold".

The problem is he got married in 2010 but file is 2010 taxes has "head of household" still.

I don't know how to file the part 21 of the affidavit of support....

21a > 1 (me)

21b > 1 (him)

21c > ??? (his officialy married but he didn't file as married, so I don't know)

21d > 0

21e > 3 (nephews)

21f > 0

21g > 0

I saw on some topics that the NVC wants the household size on the affidavit of support to be the same than the one on the last taxes, so that would force me to put him as unmarried.

But since he's married, that would make me lying on a form.

I don't know what to do, can anybody help please ?

Ouch! He should not have filed "head of household" if he was married in 2010. He should have filed either "married filing jointly" or "married filing separately". He really should file an amended return and correct it. He may owe additional taxes and/or a penalty to the IRS, depending on whether his wife was working, whether she filed a return, and what filing status she used.

If he doesn't include his wife on the I-864 then he would be lying. That is never a good thing to do. He should fix his tax return and be truthful on the I-864.

Jim gave you a good answer. I would just add a correction to your initial question. It is not YOU who would be lying on a form. He's the one signing under penalty of perjury. Yes, there may be consequences to you, like a delay in your process, but it would be he, not you who lied. Not good.

Facts are cheap...knowing how to use them is precious...

He won't do that, that's too much stuff to do (amending taxes + sponsoring) for zero benefits for him....

dry run's, or practicing to fill out the I-864, can be 'fun', yes? Sorry for this pain, but at least you know, NOW, prior to actually filing it.

IMO, doing a dry run, will expose anything untoward or bizarre.

hey - why not do a 'dry run' with his I-864, see if he'll meet the poverty guidelines, including his wife.

ie - fill out the form, run the math, see if he qualifies prior to actually sending it in.

here we go

1st RFE August 12, we need DS230 and I 864 for joint sponsor ( My brother can't be a household mambers)

2nd RFE August 15, we review the document and we need I 864

3rd RFE august 17, they need I864 and proof of relationship for I864A

What the F***

should I sand the proof of relationship now too or just ignore it
