I think you can do DCF from Romania if you are a permanent resident there (6 months of living there, I guess)... This way might be faster than filing from the US (in this case you have to be in the USA).

Service Center: California Service Center

Consulate: Austria

Marriage: 2010-11-19

I-130 Sent : 2010-12-20

I-130 NOA1 : 2011-01-05

I-130 NOA2 : 2011-05-09

Received NVC Case Number on 5/21,

Sent DS-3032 and paid AOS bill on 5/21,

Paid IV Bill on 5/25

Sent both packages on 6/1

Packages arrived 6/6

SIF & CC 6/20

Medical 7/25

Interview 8/9

Received visa 8/16

Flight to the US 10/4 (POE = IAD)

Hi,

I am not a rezident but I have a romanian passport too.

If I get married in Romania can I do DCF? does residency is a must?

Tx

You say you want to get married in the US, does your fiancee have a visa? Or do you mean your next steps in the USA, but getting married in Romania? Assuming the latter...

Residency of 6 months is a must, it doesn't go on citizenship. If you have not been a resident for 3 months or so already, then filing via the USA is probably faster. If you do file DCF, you can leave after the I-130 is with the US embassy, but to be on the save side, wait until it is approved.

Check this out: http://romania.usembassy.gov/visas/immigrant.html

"Immigrant Petitions Filed Locally

The consular section may only accept immigrant petitions filed by U.S. citizens who have been residents in Romania for at least the preceding six (6) months and have Romania’s permission to reside in the consular district (as evidenced by their U.S. passport showing date of arrival and Romanian residency card).

For more information about accepting immigrant petitions (I-130) locally, please see the US State Department’s press release."

I don't know if your Romanian passport helps...

No, you cannot applyfor DCF if you are not a resident. If you just wish to be married in Romania, in that case get married as per yous wish and then make sure you do whatever is necessary there to get your marriage certificate(I mean get it offical documented in court).

You can return back to US and then you can start your CR1 process, which should ideally take anywhere from 6-8 months.

Good luck... :)

So , what are you saying is that I can get married while I am in Romania and have my marrriage certificate recordet in a Romanian court and later on I can do the CR1 while I am in US?

Thanks for any info,

what would be the quickest route?

1.getting married in Romania and going back to US and start la CR1 process?

In this case, would my spouse get her GC when she enters the US? How long would it take?

2. going back to US and do the K1 fiancee visa( which I personally think is longer as I would have to get married once she comes to US and only after that I could do the AOS.

Thanks again.

CR-1 takes 9-12 months. I personally prefer this route because it's $ 1000 and not $ 2000 like the K-1 plus you can work right after you got the visa. With the fiancée you need to wait another 1/2 a year after obtaining the visa.

We got married in Austria in Nov., my husband went back to the US and I came to see him in Dec. Then we filed for the spouse visa, got joint accounts, I went to the IRS office to get my ITIN and so we could file our taxes in time and got a huge return. I left in March and went back to Vienna. He's going to see me in summer and I hope by the end of summer I get my GC... So you see, it's doable... ;)
