HELP- MISSPELLED PETITIONER'S NAME ON VISA

My fiance received his k-1 visa today (picked up from dhl) and noticed that they misspelled my (petitioner's) name on the visa. Apparently they wrote "OSEPHINE XXXX" instead of "JOSEPHINE XXXX". Is this going to be a big problem?

I hope not. His flight is on Wednesday night. He'll go to the embassy first thing tomorrow morning, but ugh.

9/24- I-129F received by CSC

9/27 NOA1 received in mail

9/28- Check Cashed

10/1- touched

2/23- RFE email

2/28- RFE hardcopy

3/7- NOA2!!!!!

3/28- Interview! APPROVED!

4/7 - Jimmy arrives in the USA!

Ugh. my lawyer told me that the POE guy would probably understand that it's an error. Are you positive that we have to fix it? I read a thread earlier that said that different embassies write different things in the "annotation" section (where this is written).

9/24- I-129F received by CSC

9/27 NOA1 received in mail

9/28- Check Cashed

10/1- touched

2/23- RFE email

2/28- RFE hardcopy

3/7- NOA2!!!!!

3/28- Interview! APPROVED!

4/7 - Jimmy arrives in the USA!

Yes, he must notify the US Consulate of the error. They won't give him another K1 visa sticker but they will make some "annotation" regarding the error.

Once you fiance arrives at POE, he can explain that the US Consulate was notified of the error at Peru.

How would anyone at the POE even know your name ISN'T Osephine? It is not a material issue anyway. If anyone asks, just say "Oh, no kidding, must be a typo"

No need to correct it, EVER. Once he enters the US, the visa is cancelled and replaced by the I-94

What about when you have to send a copy for AOS, the petitioner name will not match the person you married or listed on AOS papers? Would USCIS not see that as an issue?

They will see it as the consulate made a typo.

thanks guys. this was helpful. I'm pretty sure it won't matter, but we're informing the consulate anyways. I read a lot of embassies don't even write the petitioner name, it's just a thing in the "annotation" section that says "PETITIONER: OSEPHINE XXX". I'm pretty sure the officials at poe will understand, but at least we're asking the embassy, and i sent them an email.

I hope you get a reply via email at the US Consulate in Peru.

Email was no help in our case but in person notification at US Consulate in Philippines works.

Hi Im having the same kind of problem; I just found out now looking at my Visa k1 inside my passport.

Our Visa K1 USA was approved I got the passaport with it inside and just notice that the last name of my Petittioner (my husband/boyfriend) is misspelled wrong, instead of Dannunzio Jr. they wrote Danuzzio.

All the rest is correct. Do you guys think I should worried with this?

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
