Jan 10, 2011: Received RFE for I-485 (hardcopy)

Jan 11, 2011: Sent response to RFE for I-485 (Fedex/UPS do not deliver to PO Box. Only USPS does and it takes 2 days even for Express Post)

Jan 13, 2011: Response to RFE delivered

Jan 14, 2011: Touched

Jan 15, 2011: Touched

Jan 18, 2011: Received Biometric Appointment letter in mail

You are still required to file US taxes even if you were out of the country.

Did you take up any employment in another country whilst you were away with your husband? Do you file jointly or separate?

There is a form on the IRS site that explains how to file foreign income, and the tax exemption if you did..

in 2009 i was out of usa with my husband so i need to attached explanation letter for 2009 tax return do i need to attach any evidence to prove my stay out of USA or jost a letter in enough.

The reason that you were not required to file taxes is that you did not have an income. As others have stated being out of the US is not a valid reason. Your letter/affidavit explaining the lack of a tax return would concern the lack of income.

I have a related question... I just submitted my 2010. my income was very low, as I had an academic scholarship. onl $14,000 taxed income. However, I was living in Peru.. it got me very far there... so my income will show low for 2010 on my tax return. should that be a big problem? how do I prove I was in Peru during this time and that that is a VERy high income in Peru? I have a letter from the scholarship..?

What is your annualized salary/wages/income for 2011? For a household of 2 (you and spouse) the requirement is at lest $18,387. Assets can be used to make up an income shortfall. Those assets are factored at a 3:1 ratio. $3 assets = $1 income.

From what you describe it may be difficult. Is this home that you partly own a family's permanent residence? How many person's own this property? Something that you do not own individually (or jointly with a spouse) may not be accepted for the reason you state.

From the I-864 instructions regarding assets: Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner's claim of its net cash value.

yeah thanks. my brother, sister, and I inherited the house. So all our names are on it. How do would we prove that it can be converted to cash in a year? We plan to sell it in the following year, but we haven't started the process yet... I can provide proof of ownership and value, etc... I guess this wouldn't work after all?
