My 5 months are almost here :) anyone heard anything on approvals for their I 130 F2A catagory?

4/20/2010: Met for the first time

8/01/2010: Moved in together at his parents

5/29/2011: Asked me to marry him :)

7/01/2011: Started renting my sister's guest room together

7/14/2011: Got married officially

USCIS

10/26/2011: sent I-130 I-485 and I-765

11/02/2011: received Email USCIS Acceptance Confirmation for I-130 I-485 and I-765

11/03/2011: received NOA1 for I-130 I-485 and I-765

11/23/2011: Biometrics appointment for I-485 and I-765

01/09/2012: Recieved EAD in mail

02/08/2012: Interview Date (APPROVED!)

Once approved, the petition will be sent to NVC where it will sit 5 years for a visa number to come up in the F-2A priority class.

5 years for F-2A out of Mexico, over subscribed.

You never know it may pick up depending on the numbers issued in the other classifications.

I assume you´re saying that because of CSPA. But the way you put it sounds like IF ALL children who apply before they turn 21 will be protected by CSPA… and that’s just not true. CSPA gives protection to a very narrow set of individuals who meet all the requirements to be considered under it.

Not true. Age is determined when a visa number becomes available. Under CSPA, only the time at USCIS is not counted against the beneficiary. Time after approval of the I-130 does count against the beneficiary.

For example;

LPR mom files for 20 years old son on 1/1/2011.

USCIS takes 1 year to approve the I-130.

This means under CSPA, the son will get an extra year; meaning he will not age out until he turns 22 years old (21 years + 1 year pending approval at USCIS).

If the PD in the F2a is reached before son's 22nd birthday, he retains his F2a preference.

If the PD in the F2a is not reached before son's 22nd birthday, he ages out into the F2b category.

This one here is such a bad advice, completely wrong and awfully misleading … and it was given by someone in the “Members, Orginizer Group” . May be he will erase my comment!... but I just felt the need to tag it and make sure others who read it will understand that although we are very fortunate to have some very knowledgeable peple here in VJ community, sometimes we also get very bad advice… so my advice, whatever you read, always fact check it and make sure you do your homework
