One of those things, if work is a priority, then marriage first, and apply for a spouse visa is the better approach, CR-1 spouse visa costs less overall, and gets green-card upon arrival to the USA, could conceivably take a job the same day as arriving in the USA, even have one lined up before coming to the USA on the spouse visa...

K-1 is a fiancee visa, not a work visa, the K-1 is an option offered for cases when US citizen getting married overseas is difficult or impossible due to laws or requirements overseas that prevent marriage, however this is not the case in the USA. Many use the K-1 traditionaly as a "Fast" visa, however due to improvements, it is not much faster than the spouse visa.

I will probably leave the form filling to the same lawwyer I used for my k1 lool no mistakes then !

I wouldn't hold my breath...why are you using a lawyer? Do you have a complicated case?

K-1 is also an option when you find less distasteful to be separate during your engagement than as newlyweds :)

Then why are we spending our time helping you? Ask your lawyer. That's what's you're paying him for...expert knowledge.

Yes seriously, you don't really need a lawyer if you follow through the guides here. Filling the forms and preparing document is painless. The pain is from waiting mail from USCIS, longing to work and being bored to death. A lawyer can't do much on pain killing.

It's how fast you get your part done. How fast your lawyer is putting it together. How long it takes him to send it back to you to sign. How long it takes him to send it to USCIS after you get it back to him. Then waiting on USCIS. My husband had EAD approval 2.5 months after entering the US, so it is possible to have a shorter wait than 6 months.

Married - 5th day in US

Got marriage certificate - 6th day

Mailed AOS/EAD/AP - 9th day

Applied for SSN - 10th day

USCIS received application - 13th day

Approval took 59 days.

Its your choice to use a lawyer or not but it certainly does not guarantee no mistakes will be made. If you can read carefully and follow the instructions the AOS forms are not difficult to complete (and you will do it faster than most lawyers would).

As they say, nobody cares more about your petition than yourself, and a lawyer does not guarantee a smooth, mistake free journey. The guides here are great. I am Romanian, so English is not even my native language and I still put everything together perfectly...no RFE. Of course you can hire a lawyer, but it costs you thousands of dollars (and AOS is expensive enough) and it's probable that he/she'll be slower in filling out your paperwork.

I got my EAD in 83 days after we mailed the package off. Just as it has been mentioned here, the sooner you get married and file for AOS, the sooner you'll start working. Good luck!

I've read horror stories here on VJ about mistakes lawyers cause, more time and money wasted... Really the visa process is pretty easy once you research it a bit, which I did a lot even before we started the whole process. My husband and I did it all on our own and had no problems. VJ has helped so much. This place is really great.

Anyways, my husband received his EAD card in his hands exactly 76 days after we mailed his AOS package. Of course he wanted to be able to get a job but he didn't have a problem not being able to work for the first few months being here. We knew it was going to be that way before we even started the K-1 process and he was able to keep himself busy and entertained until he got his EAD. He has plenty of video games, haha. He would also help clean, make dinner, spend time with me on my days off from work, going places together, etc. I know I'd find things to do to keep myself busy if I was in his situation. It wouldn't really bother me that much.
