Timeline

Hi everyone i was wondering if anyone could answer my question.

How long does it usually take before you can work in the USA when you enter on a K1?

I am told that whilst waiting for your work authorization you can apply for another work authorization immediately upon entry into the US?

So basically on average how long am i likely to stay unemployed for?

Timeline

4 - 6 months.

The timeline:

  1. Enter USA
  2. Get SSN a few weeks after.
  3. Get married
  4. File I-485 I-765 (EAD), and I-131...

Takes 3-4 months to get EAD, and perhaps a month or two after that get green-card.

K-1 is not a work visa..

According to the timelines on this site, about 80 days from filing EAD to approval. Of coarse, you cannot file until you are married. So that adds more time.

Timeline

In theory you are eligible to ask the port of entry officer for a temporary work authorization when crossing with a valid K-1. But this will last as long as the K-1 itself, which is 90 days. Once those 90 days are up, if you did find employment, you will need to resign and wait for your green card as you will no longer be authorized to work in the US.

Otherwise you wait for your green card as YuAndDan explained. Your first is valid for 2 years and can be renewed. It's your best option.

Sure you can apply for EAD prior to marriage, I-765 #16 would be (A )(6 ).. You pay a $380, the resulting EAD card WILL expire 90 days after arrivint in the USA, and since it can take nearly 90 days for USCIS to process and issue the card, what would be the point?? Toss $380. I have seen USCIS simply reject it due to being unable to process and issue it before it would expire.

EAD IS work permit, it is the same thing, why would they issue a temp EAD for working while waiting for EAD??

The Temp work permit is "EAD" and allows working while waiting for green-card (Adjustment Of Status)

They don't give EAD at JFK anymore. You need to apply for EAD and it USUALLY takes 3 months from the filing date. How soon you can work depends how soon you are getting married upon arrival. The sooner you get married the sooner you can apply for AOS and the sooner you get your EAD. If you wait three months to get married then AOS, it could take 6 months+ to start working legally in USA.

Nov 26, 2010: AOS-EAD-AP package sent out

Nov 29, 2010: Package delivered at 1:12pm

Dec 10, 2010: Received text messages from USCIS regarding receipt numbers for AOS, EAD, and AP

Jan 11, 2011: Sent response to RFE for I-485 (Fedex/UPS do not deliver to PO Box. Only USPS does and it takes 2 days even for Express Post)

Timeline

You can file for a work permit based upon the K-1 visa. It will expire the same date as your I-94 (about 90 days from entry). Thus you will pay the going rate to apply for the EAD, it will arrive about one or two weeks before it expires, then you have to stop working until you receive your EAD or green card from the AOS.

Overall not worth the money it cost to apply for it.

One of those things, if work is a priority, then marriage first, and apply for a spouse visa is the better approach, CR-1 spouse visa costs less overall, and gets green-card upon arrival to the USA, could conceivably take a job the same day as arriving in the USA, even have one lined up before coming to the USA on the spouse visa...

K-1 is a fiancee visa, not a work visa, the K-1 is an option offered for cases when US citizen getting married overseas is difficult or impossible due to laws or requirements overseas that prevent marriage, however this is not the case in the USA. Many use the K-1 traditionaly as a "Fast" visa, however due to improvements, it is not much faster than the spouse visa.
