My fiancee and I have been going over this and I'm not sure if I told her right or not. We haven't filed anything yet. But after she is here about a year we want to file for the kids to come. So will they fall under the CR-1 or do we file under something else? I'm not sure what to do. :(

Moving to bringing family members forum...

Anyway procedure depends on age of children, and age when getting married.

If less than age 18 at time of marriage, US Citizen "Step-Parent" files an I-130 for an IR-2 or CR-2 visa for step child.

If child is 18 or older when parent's marry, it would be best to follow to join on a K-2, or get a K-2 when parent gets K-1. Step parent will not be able to file an I-130 for step child. Only bio parent can, and only after getting a green-card, the processing for this will be a couple years.

If child is close to 21, or becomes 21 prior to parent's marriage, then K-2 probably will not work, and as in case #2 bio parent can only file an I-130 after getting green-card for son/daughter, and it can take much longer to get a visa for an unmarried son/daughter over age 21 of an LPR

non of the children are 18. so we can file CR-1. That's what I needed to know thanks. So is the CR-2 filed the same time as the Cr-1?

CR-1 IS THE SPOUSE

CR-2 IS THE CHILD

They dont have to be filed at the sametime

Yes CR-2 is child.If married more than 2 years when visa is issued it will be an IR-2

Look at the costs and add them all up, depending on how many kids - if you file the K1, the kids can get a derivative visa and come on a K2 as long as they come within a year - then you pay to adjust their status. Otherwise, you have to file separate applications for them if you do the CR1

Looks like they are not considering K1/K2 they have listed Spouse visa on profile.

Also CR-1 CR-2 visas will save quite a bit on fees when considering adjustment of status for K-1 and K-2 visas.
