Refilling the petitions after the case was sent back to USCIS on Jan,2008

Timeline

My case was sent back to USCIS via 221g on Jan 2008 and it was ended in USCIS after that.

Now we are thinking of refilling new petitions , anybody has suggestions please guide me :unsure:

My K3 petition was returned back to USCIS on Jan,22nd,2008 and i am still waiting till this moment to hear from the USCIS

First, the K3 visa hasn't been viable for over a year, so if you refile it would be to start a CR1 or IR1 visa process. What you would be wise to do next depends on why the visa was denied and petition approval revoked, but certainly you're free to file a new I-130.

Facts are cheap...knowing how to use them is precious...

the cosular was not convinced of our relationship that it was geniune. because of 30yrs age difference that was the reason why the approval was revoked.

First, the K3 visa hasn't been viable for over a year, so if you refile it would be to start a CR1 or IR1 visa process. What you would be wise to do next depends on why the visa was denied and petition approval revoked, but certainly you're free to file a new I-130.

Well you can't change your age difference but unless you address the causes of the denial, refiling would have a similar result. The most important evidence of a bona fide relationship is the time you spend together in person. I would suggest arranging at least several weeks time together prior to filing again.
