Hello all:

My spouse was recently approved for citizenship(just waiting for the oath ceremony) but now she would like to bring her sister and the sister's family over to the U.S. I read the guide and I know I have to begin with the I-130 again but would like to know when will the USCIS request the I-864 info? currently she is unemployed I have a job, but would like to know when will the USCIS request I-864 info? The wait time for a brother/sister visa from Pakistan is about 10 years. In ten years times she will have a good job with really good income, but I am worried about filling the I-130 now and then having to prove enough income for 4 people(the number of people in sister's family).

Thank you in advance for all of your help

If the category still exists, a lot can happen, certainly something that might go as part of CIR.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

she only has to file the i130. nobody knows what will happen in over 10 years. You can be her co sponsor or she can have a joint sponsor, who knows?

Don't worry about the i864 for now.

The I-864 is due about a year before the immigrants immigrate to the US. So, you and your wife will not need to worry about it for another 10 years.

The I-864 is the Affidavit of Support for the intending immigrants. You are responsible for reimbursing the US government if the immigrants receive certain public benefits. Your financial situation now is irrelevant. It becomes relevant when the immigrants are about to come to the US.

I-864 is gathered up at NVC, never at USCIS with initial I-130 submittal. There will be years between I-130 approval and the start of NVC action.

Good Luck !
