travel during aos

Filed: Timeline

We married and applied for AOS and EAD.Did not apply for travel permit. What is the process for travel outside the USA during the application process.None emergency travel .Wife wants to go back to Ukraine to get the rest of her clothes and to see mother.Will be gone maybe 2 weeks.Filed for AOS about 1 week ago.No delivery receipt yet.

She cannot travel until she has her travel permit (Advance Parole), or her GC. If she leaves the country, she will automatically abandon her AOS and you will have to reapply for a spousal visa. You can apply for AP by filling out the form and attaching a copy of the NOA from your I-485 - it's not too late. You could alternatively wait until you have the GC, which gives travel rights. Good luck.

They are one card now, but I thought you still have to apply for each separately. Good point though.

You do have to still apply for both separately.. and it seems like some are getting the joint EAD-AP card, others are still getting two separate documents.. I think it will take them a while to start issuing ONLY the joint cards :) But in any case, yes, both still need to be applied separately. OP, as Harpa Timsah said, just wait until you get the NOA for the I-485, fill out the I-131 form, attach a copy of the NOA and send in the I-131. It can take somewhere between 1-2 months for the AP to be issued though, and before she has that in her hand she cannot travel.

February 14, 2011 - On February 11, 2011, U.S. Citizenship and Immigration Services (USCIS) announced the creation of a new employment authorization document (EAD) which also serves as an advance parole (AP) travel permit. The new card will be available for persons who concurrently file an I-765 application for an EAD and an I-131 application for an AP with their I-485 adjustment of status application in the final stage of the permanent residence process. The card will be valid for either one or two years, depending on whether the applicant’s immigrant visa preference category is retrogressed. The card will look identical to the current EAD but will have an annotation that states “Serves as I-512 Advance Parole.” Notably, if an applicant only applies for an EAD or an AP, USCIS will issue the legacy version of the EAD or AP. The new card will continue to be a valid List A document for I-9 purposes.

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011
