Do you need to be living and working in the USA to file the petition?

I'm a US citizen currently in the UK on a work visa. Do I need to go home to the States to file the petition for my fiance's K1, or can I mail it to the US address from my residence in the UK?

Can I stay in the UK with my fiance until he has his visa, if my parents in the USA agree to sign the affidavit of support?

Sep 2009 - Met at University in UK

Apr 1 2011 - Engaged!

Apr 18 2011 - Sent I-129F...hoping for the best.

Apr 29 2011 - NOA 1 - California Service Center

Jul 14 2011 - NOA 2 (76 days after NOA 1)

I have not been a resident for 6 months yet on this visa, so we would need to wait first. And the DCF times for London are 10+ months. We're thinking a K1 might be faster.

You could do what you suggest as long as you have an American address where the NOA1 and 2 can be sent. You can use your parents' address, especially if they are willing to be co-sponsors for the Affidavit of Support.

You could do what you suggest as long as you have an American address where the NOA1 and 2 can be sent. You can use your parents' address, especially if they are willing to be co-sponsors for the Affidavit of Support.

Correct. You would actually use your parents address as you current residence though. You are only visiting the UK. If you list your current address as foreign, they won't accept the petition.

Facts are cheap...knowing how to use them is precious...

The important thing is to use a U.S. address on your I-129f. I think about the G-325A worst case scenario you'd get a RFE to clear things up.

That's what we're doing, and it's working out fine so far. Good luck to you.

May 2008- L is pushed into jagged rocks by a 12 ft wave while surfing in Chile. K saves her from certain watery death. Performs CPR and secretly enjoys it.

Sept 2008- L returns to the U.S. to finish school.

Dec 2008- K wins a surfing competition, uses prize money to buy L ticket to Chile.

Jan 2009- L visits K in Chile, 5 months pregnant!

April 2009- future world champion of surfing is born

Nov 2010- engaged!

Nov 28, 2010- petition sent

Dec 3, 2010- NOA 1

Dec 10, 2010- touched

If you are officially residing in Thailand with the applicable visa and/or status, fine. Otherwise you are "visiting" not "residing". Addresses you "visit" don't belong on any G325a forms.

It's like going to college. When kids whose parents pay most the bill go to college, they don't usually change their ID etc to the new address...they keep their residency in the original state and are away at school most the year, and they come visit once or twice a year.

It's like a temporary assignment abroad--you can have your driver's license and mail at your parents'.
