I-864W submitted and ignored

Hello,

I'm the immigrant in this situation: I submitted in full my AOS/green card packet after recently marrying my USC husband. I've been in the US (legally - on consecutive TNs) for a number of years and have earned 40 SSA credits. I filled out and submitted a I-864W with a xerox of my annual SSA credit letter showing this. BUT I just received a yellow slip in the mail requesting a I-864 from the sponsor. Thoroughly confused...

I've done all the foot work myself on this and feel confident I've followed all the directions. I feel like I have three options: call USCIS and discuss (which I don't have high hopes for), hire a lawyer to deal with this (which I would like to avoid for money reasons), or just submit the I-864. The last seems the obvious choice but since we'll require a joint sponsor (my husband's father) it's not ideal.

Has this happened to anyone out there? Is there any hope in calling USCIS and talking to a rep?

The person processing the form "intake" may not be familiar with the 864W. The go through a check list and make sure the basics are there.

Perhaps you could make an InfoPass appointment at your local USCIS office to hopefully get this straightened out.

What visa are you AOSing from? :time: I get the feeling from your post that you're not AOSing from a K visa so you should post and read here: http://www.visajourney.com/forums/forum/130-adjustment-of-status-from-work-student-tourist-visas/ as the current forum is for AOS applicants from K visa (family visas)

If you have qualified for the 40 quarters, then the first option is definitely the one you must go. Phone USCIS, make an InfoPass appointment...they should eventually accept that you are right, although it may take talking to several knowledgeless people first.
