We met on a dating website, and no, they didn't focus on that much. They did ask why we got engaged after only a few months, and the chats, they asked about chat logs. When he said we didn't have any, she asked if he was sure he didn't have any at home. That was when he explained to her the issue we had with our chat logs last year. We sent a TON with our k1 petition, and he brought more to the interview. The guys said first thing, that he hated our package. Why did we send so much chat. Then gave hubby ###### for bringing even more chat. So this time, we made our cr1 package simple. And besides, we don't really talk on chat anymore. Its all text, phone and skype. Also, dating website was coed, and not country specific. And he does not have any american friends

I have a suspicion that they have decided to deny it on this one. I know it sounds strange since they complained the last time that there was too much, but you should have still provided something that proves you talk on a regular basis.

That being said, is there something that you can gather ASAP to show that you do still chat consistently?

I agree with morocco4ever. Even if they don't request or ask you for it - send them the proof, stating that your husband was asked for it in the interview, and you'd like for it to be reviewed.

Also, when you send your email for today, ask specifically for your case to be reviewed by the Consular Chief. I think all these things are helpful.

He did go with texting and phone records but I do think your right about the chats, since she did ask him if he was sure he didn't have any at his house. And no, I don't mind the questions or suggestions, I appreciate them. Nothing from the consulate today

In a way, the no response yet from the consulate is good. You can email them, request that the case is reviewed by the consulate chief, and inform them that since they were asked for in the interview, you are sending chats that can be reviewed by the consulate chief. I don't know about how they are downloaded or printed, etc but can you scan and email them, or can he send them?

I would include the proof you already gave them - the texts, etc AND the chats, and indicate that this is your communication and you'd like it to be reviewed in totality.

Actually if you do have a representative assisting you they might take it more seriously if you can get them to submit it to Casa for you.

Great point M4E. Or both you and the politician submit it.

I don't mind to recommend you going overboard, but I felt like with our situation, the more Casa heard from us, the better. And, the more we and others provided to them, the better.

I actually didn't get a sense that they even responded seriously to the senator we had working on the case. They just kinda blew them off, from my perspective. I'd cover all the bases and both submit. With Casa, you just never know.

Any thoughts on the free legal consulations?

This situation is so crazy to me... You've been together for over two years and MARRIED for over a year! How can they even presume to tell you two that they don't believe the relationship is real?? :bonk: It's just maddening and the more I read of your story, the more baffling things get. I have nothing of any real value to offer aside from a word of support. I hope things start looking up and this gets resolved soon so you can be reunited with your husband. I hate it that this is happening to you both.

Passing harsh judgment on those you don't know says nothing of the judged and everything of the judge.

Just because they have been married for a year or whatever doesn't prove anything to the consulate. How hard is it to be married on paper and not live in the same residence? Do you really think if someone is trying to immigrate for papers that that is too much for them to grow through to get here (I am not saying this is the case in their situation, I am just saying? As many have said before, something with this case doesn't sit right with them. Whether they are right or wrong in their assessment still remains to be seen. They interview potential immigrants every day and do have some insight into what to look for in fraud cases.

Wow, a light went off in my head when we started talking about the chat logs! After you guys said that, I text my husband, and asked him if they even looked at his evidence, the phone records and text records. He said no, she only asked to see chat logs, and the photo album. I am already organizing what chat I do have, even if it isn't as much, it shows some conversation, and phone calls through skype. I emailed my senators to see if they will send this info for me, and I will send it to the consulate also. I am almost positive this was the problem, as that was the only thing she was concerned with, and even asked my husband again, "are you sure, you don't have any chat logs at home? because you can bring them in."

I'm so sorry, Tany. I don't understand why he's getting denied again. It sounds to me like something during the interview put them off. With federal interviewers, it can be something in his body language that isn't matching his answers. I've been an interrogator, and there are things they look for to indicate deception that can negate the right answer to any question at an interview. Body language doesn't get the kind of attention when discussing preparation for a visa interview that it should, yet, it makes a big difference.

I am not expert in this process as I am still trying to resolve our concerns about my husband's difficult interview, but I realized something about some things getting lost in translation. After careful review of the detailed account of his onterview, I discovered that the interviewer used phrasal verbs in a context that my husband. Example would be using the phrase Why did things not work out. Individually they have a completely different meaning that when used together. I am not sure if that could apply to your case at all. With that being said, it is possible that your husband may have answered the questions correctly but the interviewer may have taken a different meaning than your husband wanted to convey. You couple that with nerves and certain body language that may have raised a flag or two and the results may not be as one desires.

I hope that you can get a second review review of your case and a possible second interview. I will pray hard for your situation. Take care.

Finally got this response, the usual song and dance....I did send our chat logs in the email I sent last night.

Dear Madam,

Thank you for your e-mail inquiry. Your husband’s case was returned to the Department of Homeland Security's Bureau of Citizenship and Immigration Services (USCIS) for further review. Due to the personal nature of the information, the file was sent via registered diplomatic pouch (Reg ######). The Bureau of Citizenship and Immigration Services will contact you to discuss the return of the petition to their office. If you wish to seek information on the status of the case, you should contact the USCIS National Customer Service Center at 1-800-375-5283. You should wait several weeks before calling them so they have a chance to receive and review file.

The decision to send the petition back for additional review was not taken lightly. Your husband’s file was fully reviewed by the consular officer. As you know, this is not a final refusal of the visa. Rather, USCIS will review the case and give you the opportunity to answer the concerns raised in the interview. Because the file has already been sent back to USCIS, please direct all further inquiries to their attention.
