Hello, I am brand new to the visa process and I am very confused. My boyfriend lives in Turkey. He is a student and lives with his mother. I have been to Turkey to visit him, now I want him to come to the U.S. to visit me. What visa should he apply for? Eventually, we would like to marry in Turkey and live in the U.S. But I don't know what visa is the easiest to get. Any help is greatly appreciated.

if you want to get married in Turkey then get married there and go for the spousal visa. The K1 visa is a fiance visa so you get engaged and then you come and marry in the US after you get approved and do the interview etc.

The visa you are thinking of is called a visitors visa, the problem is that he has to prove he has strong ties to his home country to get it and someone living with parents usually doesn't have that kind of proof.

This will not be over quickly. You will not enjoy this.

Has your boyfriend ever traveled outside of Turkey before? If not, since he's a student and lives at home, I imagine it would be fairly difficult for him to get a visa to see you in the US. Not impossible, but he (and you) would need to prove very strong ties for him to return.

As for marriage, it takes a significant amount of time and money to go through the visa process, so you should really read through the forums and learn about the pros/cons of each visa. I was fortunate to be living in Turkey and when my husband and I applied for his visa, so we went through DCF (filed in Turkey in Ankara vs having to file in the US) and that is a much faster process. I had been living in Turkey for several years, so it's what made sense for us.

4/10/08 - Married in Istanbul!

5/14/08 - Sent I-130 to Ankara via UPS

5/15/08 - Packet arrived in Ankara at US Embassy

6/2/08 - Received email from Embassy, our interview is schedule for 8/11/08

8/11/08 - Interview at US Embassy in Ankara, I-130 APPROVED!!!!!!

8/13/08 - Visa RECEIVED.....

11/7/08 - Flew from Istanbul to Denver (via JFK)

11/21/08 - SSN received in mail

12/18/08 - Green Card received!!!

I-751 (lifting conditions)

8/10/10 - Sent to California Processing Center

8/20/10 - Received AOS letter

8/26/10 - NOA received biometrics appointment notification

9/16/10 - Biometrics Appointment in San Francisco

10/7/10 - Approved!

Citizenship

1/24/12 - Date filed

5/30/12 - Oath Ceremony!!!!

Which would be easier? Getting married in Turkey or the U.S.?

In My opinion, it is easier to get married in the USA, BUT if your boyfriend is not able to obtain a tourist visa then you would have to get married in Turkey which would be just fine... would take a little longer BUT that's what you may have to do if you don't decide to go the K-1 route~ If you were able to go to Turkey and live for a short time and get your permanent resident permit after 6 months of residing there you could do the DCF which normally takes 3 months or you can marry there in Turkey go back to the states and do the CR1/IR1 process from there.

Either way you will be fine and good luck!!!

A fiance who is a student living with parents in Turkey has nearly no chance of obtaining a visa to visit you in the USA. For your plan, you marry in Turkey then follow the CR1 visa path. Do you think it would be quicker to apply for the fiance visa and get married in the U.S., or get married in Turkey and apply for the spouse visa?

Fiance is usually quicker to get him to the US but then there is the wait for the employment authorization and green card which you can't apply for until after you are married and then it takes 3 months+ to receive. This would be a lot of down time for him where he can't work, maybe can't get a driver's license, etc. The positive is my hubby (came on a K-1) used the time to take ESL classes (english second language) and to become accustomed to the US culture.

The CR-1, where you would marry in Turkey, would give him his green card withing weeks of his arrival in the US. And it is overall less expensive.

Please do remember his being from Turkey he will likely have to undergo Administrative Processing which will add time to the visa issuance either way you go.

If your boyfriend comes from a wealthy Turkish family, then obtaining a tourist visa will likely not be too difficult. Generally, a citizen of the EU will have fewer problems entering on a tourist visa than a citizen of a "developing" country like China or Vietnam. However, Consular Officers sometimes ask applicants if they have family members or boyfriends/girlfriends in the USA. If the answer is yes, then they may deny the visa on grounds that the applicant may choose to overstay or adjust status. If your boyfriend REALLY plans to return to Turkey after a short stay, then I encourage you to go for a tourist visa. During the interview, your boyfriend shouldn't "volunteer" information that he has an American girlfriend; but he shouldn't deny it if asked by a Consular Officer. Honesy is the best policy. By the way, if you can visualize him staying beyond his visa expiration date, then forget the whole tourist idea and initiate the Fiance Petition process instead. It is my understanding that USCIS does not think kindly of lovebirds who enter the USA on tourist visas and quickly marry and apply for Adjustment of Status (AOS). Do it right the first time, and you will have fewer hassles down the road. One final word of advice: your boyfriend should ALWAYS be truthful when answering questions from a State Department or USCIS official. Getting caught in a lie can result in an entry ban of 5 or more years.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
