My wife and I have been married one year now, she has her SSN and has been working the last few months. Last week her employer ask her about her I-765 if she was able to work after may, due to expiration of it in May. Do we need to apply for a new I-765 for another year until we apply for her full citizenship? or can she continue to work due to her already being a USA citizen by marriage ?

It sounds like you forgot something somewhere?

EAD is not usable once she has her green card. Does she have this?

She needs to have the 2yr card, then just before the expiration she must apply for ROC - removal of conditions to get her 10 yr card.

In 3 years from the date of the first GC she can apply for citizenship.

There is no "US citizenship by marrying a US Citizen".

Firstly she is NOT a US citizen. It is highly illegal for her to be claiming to be a US citizen when she is not one and if found out can get deported with a lifetime ban.

You have not added your timeline so I can't see whether she has her GC (green card) already. :time:http://www.visajourney.com/timeline/

IF she has her GC she is a US resident(not citizen) and doesn't need the I-765. The GC should have been registered at her work once she received it. The EAD (i-765) was invalid once her GC was approved. She could also have taken her SSN to the SSA with her GC and had the "DHS authorisation" restriction removed which reflects that she doesn't need the EAD.

Sorry guys my wife does have her green card and within 90 days of our second ann we will apply for the ROC. We did not know that once she recieved her green card The EAD (i-765) was invalid once her GC was approved. Also my words was wrong she is not a US citizen by marriage but a resident by marriage. So all she needs to do is inform her employer that the i-765 is invalid since she has her green card.

So all she needs to do is inform her employer that the i-765 is invalid since she has her green card.

Have her bring the green card in for the employer to see that she is in fact legally employable.
