I am going to visit my fiance in the US in a couple of weeks. Thought while I was down there I would gather the docs needed for interview even though it will probably be July before that happens. (Go VSC!!!)

My question is: my fiance is a farmer/rancher so is basically self employed. He has no pay stubs, letter from employer etc to prove income. Are tax returns enough? If so do I need the originals? Also I know he hasn't filed 2010 yet, will I need that return or will 2007, 2008 and 2009 work? Any other ideas? Any help would be appreciated. Thanks!

Hi,

I'm a farmer that is married to a Canadian. When I filed our petition I used IRS tax transcripts for the 3 preceeding years. I would think that he will soon be filing for 2010 and you can request a transcript for 2010 as well. Transcripts are provided, by request, by the IRS and are free. I filed out the financial information as required and included bank statements. The most important thing is that his income is high enough to satisfy the poverty level threshold or he has sufficient assets to support you and himself. If he is financially secure there shouldn't be a problem. Wasn't for us anyway. Good luck, hope this helps.

Yes that helps. This may sound like a dumb question, but what is the difference between a transcript and tax return? We dont have transcripts up here in Canada. Also, what do they take into consideration for income, gross or net?

A tax transcript is created by the IRS, it summarizes the tax return submitted to them by the taxpayer. It will show each line of the tax return, it will show gross income and net income as well as taxes paid. I think it is prefered as it is a document that proves a return was actually filed.

My USC Husband is a dairy farmer and we're having trouble because he writes everything off and uses depreciation so his income appears very low. We've gotten to the point where we have to file 2010 taxes to show a large income and will just have to pay the income tax that comes along with it. I hope all goes well, but one suggestion is to send a copy of the business license. We didn't notice any request for it in the instructions, but after we sent the I-864, they requested it. Sending it right away could save you 6 weeks of lost time!

We talked to our tax guy and to show $19,000 income, we only have to pay $1,600 for SS and Medicare. He also said that we can re-file in June once I have my visa! :)

Thanks for that. My fiance will be happy knowing he can re-file and really that is not that much to pay anyway. About half of what I have to pay here in Canada for my farm income. Appreciate your help! Good luck with your interview and the rest of your journey!!
