Letter Certifying Pregnancy & intent to marry

I'm following the advice of everyone here and drafting a letter to include with our K-1 package. Here's what I have so far:

To whom it may concern:

This letter is to certify that I’m aware of and the father to the pregnancy of the beneficiary, Amy Antonio, to this petition for her K-1 status visa. The date of conception was approximately January 10th, 2011 during my stay in Manila. A check of the passport pages supplied with this application package will prove that this date is within the date ranges of my stay. I also certify my intent to enter willfully into this marriage with the beneficiary within 90 days of her entrance into the United States.

Would this work? Should I change or add anything? The only thing I can think to include with it would be a copy of the ultrasound picture I have and the chat transcript for the date that she confirmed we are pregnant. Thanks in advance.

There is no need for the pregnancy statement what-so-ever. Kind of sounds like your only intent to marry her is because shes pregnant! You talk more about the pregnancy than intent to marry.

I would remove the pregnancy statement and just leave it as an intent to marry.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

Inky,

I found out about the pregnancy AFTER I proposed. So, no. The marriage is not because of the pregnancy. However, the purpose of the letter would be to inform the USCIS & Embassy that there's a bundle of joy on the way, I'm aware of it and intend to proceed. I have other letters of intent to marry included in the package. I believe this is from the USEM's website in their FAQ section... See this post for the basis of the reason for the letter:

FAQ

Q. What if my Fiance is pregnant and this is not disclosed on the approved petition?

A. Visa processing can continue in this case if the consular officer obtains a statement indicating awareness of the pregnancy and the desire to proceed with the marriage.

work for what? The issue of pregnacy is completely and totally irrelevent to the I-129f petition. You need to BOTH sign letters of intent to marry. The sample letter here on VJ works perfectly well.

USCIS could not possibly care less if your fiancee is pregnant and who the father of the child is. It need not be mentioned.

You may need this letter for the interview...if the child is not already born by then, but not for the petition.

The pregnancy is of no concern to USCIS....it will be to the consulate but you can mention all that in your updated letter of intent that you will send for that.

Congrats on the little one on the way.. unfortunately, USCIS aren't really the touching and caring types! \

Just keep the letter to the sample. It works. It's been accepted. No need to complicate things at this stage.

Previous posters are correct. All USCIS cares about is if you get married. Whether she's having your baby or not... they don't care.

Might be a different story when it gets to the Consulate level... but for the I-129F petition, the pregnancy part is worthless.

Gary,

Thanks. I guess I'm just thinking too far ahead at this point. Am I correct in thinking that this letter wouldn't even be necessary if I'm there for her interview?

I have letters of intent (using the examples from here for this) from both my fiancee and myself (signed and dated). I believe I'm good in this area. Thanks. However, this does bring to mind the question of if the updated letter of intent is still needed for the interview if I'm in attendance. Either way, I'll draft one and include the pregnancy mention at that time so they'll have it for their files.

The letters of intent are fine.

as for your knowledge of the pregnancy, that depends on the consulate. As I understand in Ukraine, if the medical exam reports the fiancee is pregnant, the petitioner must acknowledge this and accept the pregnancy (whether he is the father ir not is none of their concern). I am not sure about your consulate, ask in the regional forum. I am sure you are not the only case with a pregnant fiancee. I was at the interview so could have done that if it had been an issue for us.

Updated letters, again, depends on the cosulate. Ukraine says they need them, we had them, they did not ask for them. Go figure. I was at the interview so maybe that was enough or maybe their instructions were not updated. In either case it is a simple letter that you can prepare and sign yourself so ...WHY NOT? Better to have it and not need it.

IMO, the more appropriate place to discuss the pregnancy would be an EOR letter. The intent to marry letter needs to be solely about the intent to marry as previous posters have said. Also, instead of stating the approximate date of conception, just indicate something along the lines that she became pregnant during your stay and then state what the date range was. Afterword, you can write in the EOR letter when you found out.

So what did you wind up doing? i am in the opposite situation, as a pregnant USC.

What's wrong with getting married because of pregnancy? Why wouldn't that look like a legitimate relationship?

I mean, i know these days ppl don't always bother but historically it was pretty much what you did in that situation!

There's nothing wrong with getting married because of pregnancy, but whether a visa is approved or not is in no way affected by a pregnancy.

Yeah... I mean i don't expect it to help, but i would hope it didn't hurt the case either. Neutral is good :)
