Hi everyone, just want to ask a question regarding the application for removal of condition. This is my situation.

My conditional gc(based on marriage) will be expired on mid of Sept. but I'm planning to visit home in August and be back in US a week before my gc expires.

My friends advised me to file for removal of conditional before I leave the country but I'm scared when USCIS scheduled my biometrics and interview I'm out of the country OR if file a week before it expires might not be a good idea?

ANY SUGGESTIONS?

I appreciate any comments and advice.... THANK YOU

Hello..I'm not sure but as far as I know, you should file your Lifting of Conditions(I-751) within the 90 days before your conditional greencard expires. You can check the link below regarding Lifting of Conditions for conditional resident. Plan things out before you leave because if you fail to file, your conditional resident status will automatically be terminated and the USCIS will order removal proceedings against you. 2011-19-01 -Received Biometrics schedule!!

2011-07-02 -Biometrics done!!..thanked God!!

2011-17-03 -AOS Interview..APPROVED!!

2011-24-03 -GREENCARD received!!..it's green indeed!!..lol..

lol..sorry..I did my best to post a link from a guide here in Visajourney regarding your question. I really don't know why it appears My Link..lol..but I really hope it will help..btw, your friend is right..if you are worried that much, why not just travel around June or July? so that whenever you come back again here in US, you can file around August..and if you are really worried(hehehe), then just visit Philippines after your ROC or once you get approved with a 10-year gc..God bless again!!..

I also agree with pookaphilus and your friend, to file it before you leave.

Just an idea here...

If you file around mid-June (around 85 to 89 days before your GC expires), it may work. From the timeline of others VJ members, applicant at CSC gets biometrics in about a month after they file so you'll likely get your biometrics in mid-to-end July. As for the interview, if you do have to go through with it, then you can try to reschedule. On the flip side, if you're not picked for interview, then you'll have your 10-year green card when you get back.

Things I don't know is, if it comes to rescheduling interview, how to do it or what impact it does have on time to get GC. Also, you've to be on top of things in terms of getting package together and sending it with next-day delivery and stuff so it goes as fast as possible to get biometrics in a month.

I also agree. Definitely file before you leave! Count back 90 days from the day your card expires and I would have everything ready to send that day. I'm sure you will have your biometrics appointment before you go. As far as if you get an interview...I have asked USCIS about this a couple of weeks ago.

My husband and I are filing our I-751 today & his green card expires in June. We have already purchased plane tickets to visit his family in Jordan this September. USCIS says their "estimated" approval time for I-751 is 6 months..so for us September is 5 months from the day we file so I was worried about possibly getting an interview date scheduled (if we have to have one) when we are out of the country. The lady at USCIS told me that if you get an interview letter and there is a conflict with the interview date, call them immediately to reschedule. It will delay your app, but if you miss it then you will be in trouble. But I've read on here that only 5-10% get interviews so the chances are slim.

My advice would be to file as soon as you can so you get the bulk of things out of the way before you go. Plus you need the NOA1 that extends your green card for a year to be able to travel outside the US after your actual green card expires. I would say to file & get your NOA1 so that just in case you get stuck or planes are delayed extra days PAST your expiration date, you will have no worries since you have the 1 year extension.
