Hello All,

My husband and I were married in the States in March of 2010. After our marriage, he returned to Belfast to reside until he receives his approved spouse visa. I currently live in Colorado.

We began the visa process in May of 2010. At this point, our petition has been approved and we have formally applied. Our documents and application are currently in review at the National Visa Center as of around Feb. 23, 2011. We did have to send an extra set of passport style photos of my husband last week. Although we included them in our application packet, we were asked for another set. We mailed those off yesterday. The formal request was made several weeks ago, but there were mailing isssues.

Here is my question:

We expect the next steps to be approval, and then a set up of his medical examination and interview to take place in London.

When he finally gets his interview date, how will I (as his wife) be involved? Will I interview as well, but in a US location? Where would this location likely end up being? Would by interview date be scheduled to about the same time as his? Lastly, when is a reasonable expectation for our interview date to actually be (his, mine)?

Are you applying for a visa too? then yes you will have a visa interview in the USA for whatever visa you are applying for.

Not applying for a visa? are you a USC? your husband is the only one applying for a visa? then no you have no interview and hes the only one applying for a CR-1/IR-1 visa.

No, I'm not applying for a visa. I'm an American citizen living in Colorado. I guess I thought I would be interviewed as well so that NVC could be assured that the relationship wasn't fraudulent. Seems like they'd want to talk to both parties.

kclloyd: unless your case is pegged for a Stokes Interview, then you will not be interviewed.

Sorry...I'm not familiar with the term "Stokes interview." Could you explain what this is?

That is used when USCIS has serious doubts about the evidence presented. The two parties are questioned separately and their answers compared.

In your situation only your spouse will be interviewed. If they interviewing officer wants more info they will issue a request for more evidence (often a blue slip) to be submitted.

Do Stokes Interviews really happen when its a CR1/IR1?

Ive only seen them in the context of an AOS.

I know sometimes the USC will get asked to an interview if there are serious doubts, but my knowledge of a Stokes Interview is that the Petitioner and Beneficiary are interviewed together, and then separately to see if their answers match up

USUALLY, the USCitizen petitioner is never interviewed

but...

[not stokes interview related]

Sometimes (though it's rare) -

a USC petitioner will be INTERVIEWED prior to I-130 final adjudication/review/approval.

When the petitioner is pegged for 'local interview' -

the casefile is sent FROM USCIS (EAC or WAC) to the LOCAL USCIS OFFICE, then an interview is scheduled WITH THE USC.

For most (99 percent and up, IMO) petitioners, this doesn't happen.

For those petitioners that IT DOES HAPPEN TO - something ELSE is a problem, many times something unrelated to the petition itself, but something popped up in the background check on the PETITIONER, and now USCIS wants a local interview done ON that USC Petitioner.
