Hi everyone,

I am a US citizen living abroad and am applying for my husband to get an immigration visa. He was denied last year, but we are now able to try again. When we were at our first interview, the consular officer requested to see evidence that we would be moving within 6 months. We hadn't prepared that material. Now we are going in a month to the interview so I'm pulling information together. What would be sufficient evidence that we would move within 6 months? Our plan is to move into my parent's in-law apartment (as it's now just a storage space), until we both are working and can find our own place to live. I'm a freelancer so can do my work anywhere so I won't be applying for a new job.

Any suggestions would be greatly appreciated.

OP, I am moving your thread as they way you are applying (via the embassy) is a special process called DCF, and your husband won't get a K3, but a CR-1 visa or IR-1 if married more than two years.

As to proof, it is difficult... you could contact some estate agents and see what is available for you once you move into your own home, as well as get your in-laws to set up a lease you two can sign. Do you still have any US bills 9cell phone for example), or a US bank account or valid driving license? Show those. Sign on with job agencies local to where you are moving to and show that, and/or get some of your regular clients to send you letters stating they know you are moving and will continue to contract with you.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

EVIDENCE OF DOMICILE: Documents which evidence the Petitioner (1) resides in the U.S.or (2) is residing abroad temporarily, has a principal residence in the U.S., intends to maintainthat residence for the foreseeable future, and has continued ties to the U.S. A Petitioner may reestablishdomicile in the U.S. by taking a combination of credible steps to make the U.S. his orher immediate principal place of abode. Such steps may include finding employment,purchasing or renting a place to live, registering children iu school, obtaining a professionallicense for a specific locality, enrolling in a full-time education program and other indications ofresidence.
