Hello!

silly question. By the end of this current trip to Thailand (I took a leave of absence from my job) I will have been living in Thailand a little over 6 months (Double-Entry Tourist Visa) visiting my fiance. I know I should check with the American Consulate in Bangkok regarding their specific policies on DCF, but I am wondering even if they would accept us doing Direct Consular Filing is it realistic to think I could could complete and submit the paperwork at the 6 month mark and then leave and return to my job in the US a few days later? It seems like I would have to stick around for something or other? Yes? No?

I emailed the consulate in Bangkok my questions but they did not write back :(

You have to be a legal resident for 6 months to file DCF. You can file the initial docs for a K 1 from Thailand to save time or if you are certian you want to marry do so & then file for a C R 1.

The consulate probably will not give you much advise. They are not responsive to emails as we would hope. Those emails are filterd thru staff before they go to an officer most of the time.

It is true that the USC can leave the country once the I-130 is filed, but your plan won't work on two fronts:

- DCF is only for spousal visas, not fiancees.

- To do DCF, you need to be legally resident, not on a tourist visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
