Hi,

Well, here goes...

I am about to send off my K-1 I-129F petition.

Ultimately, my fiance and I would, someday, like to spend 6 months in the US and 6 months in Thailand each year. That is the 'dream' scenario.

Does anyone know how long it will take until she would be allowed, risk-free, to spend 6 months out of the country each year.

After she comes to the United States we would like to live in the US for two years on a year-round basis, but I have read some other posts that say it could be up to four years until she could come and go with me from the United States as she pleases. Does anyone have any thought about how long it would really be if we were on top of our paperwork and had no delays :)?

Would getting married in Thailand and then using the K-3 Visa speed up the process wherein she can leave the United States each year for 6 months?

She can come and go with you as she pleases as soon as she becomes a LPR and gets her green card, as long as the majority of time is spent in the US.

That being said if she ever wants to be a citizen she has to show a record of living in the US for a good period of time. I would have her become a citizen and then start your plan.

Agree.

Any extended visits outside of the US can be held against you. Especially if you have the full intention of permanently resided outside the US for such a period of time. This could result in your greencard being revoked.

Your safest bet is get the greencard, then apply for citizenship (because you are married, you can apply for citizenship after 3 years of being married and holding a greencard), have that granted, and then you welcome to enter and exit the US as many times as you like, for whatever period of time, with no hassles whatsoever.

02/02/11 - AOS moved to CSC

03/07/11 - Greencard Approved!
