90 days passed,, service request filed too still no update on EAD

  1. 1. Did infopass apointment helped after you put in a service request after the 90 days of filing for EAD?

    • Yes somewhat ( I got an update on my case within 2 weeks)

    • Not really, I needed to wait additional time before I could put service request
    • No, they told me I needed to wait and there is nothing they can do about it.

Timeline

Ok I know all the "be patient, you know that is the game, we had it way worse than you" comments, because I know I am just winning and I should wait (most of you are real troopers which unfortunately I am not:( ). I am in the dark of what now, that is why I am posting this topic. My accurate timeline is this:

- December 26th petition for permanent residence ( I-485) + petition for employment authorization ( I-765) were received by the USCIS.

- January 3rd, - they sent me notice of action on both cases, official acknowledgement of them receiving my application ( both of them)

- January 5th - Biometrics appointment was sent to me for the EAD

- January 20th - RFE for I-485 ( tax records required, employment verification for the affidavit of support)

- January 26th - Biometrics done in Seattle USCIS office in Tukwilla

- February 26th - RFE sent ( finally we got all the docs needed)

- March 1st - Called the uscis, they put a wrong service request (non-deliverance of EAD)

- March 3rd - USCIS acknowledgement of received Response to RFE, I-485 updated ( we will notify you in 60 days about our decision.

- March 7th - Email received regarding the service request of ( non delivery of employment authorization card(On 3-3-11 we received your response to our request for additional evidence on your I-485 therefore, the processing has resumed on your pending applications.)

- March 10th - called the USCIS, they explained to me that one of their agents put in the wrong service request and when within 75-90 day approaching the 90 days, they can put a new service request so I can get some info on my EAD (since it has not been touched since January 5th)I was also told, that regardless of request for evidence, if a response was received by the uscis, I am entitled in a decision.

- March 16th - (10 days before 90 days expire) put in the right service request ( approaching regulatory time frame) for EAD. I was told the I am gonna get a response within a week from the USCIS by mail or e-mail.

-March 18th - update on my I-485, ANOTHER RFE.

-March 21 - RFE received, sent back the same day ( another tax form )

-March 21 - letter was sent on this day to me regarding my service request ( the right one ) saying : Our records indicate that we are awaiting for your response to RFE, your case is currently on suspense or on hold until we receive that response. and they sent me a copy of the RFE notice.

-March 25th - USCIS acknowledged the response to RFE

-March 25th - I received the fore mention letter regarding the service request.

- March 26th - 90 days are done.

- March 27th - Calling the uscis to see what does it mean, is my service request still valid, should I put in another on. The agent couldn't understand that I had RFE on I-485, but it put my service request on I-765 on hold. they couldn't do anything about it, and I have to wait 31 days to put in another service request. That is April 17th. They advised INFO-PASS appointment, but they weren't sure if the local office can help.

- Today - Called the uscis, they explained the answer I got on my service request is final ( I wont get anymore updates on that? ) and the status is as in the letter I received a week ago, and I am not eligible for another service request.

Now I dont know what to do, and most of all is just more and more torture. No one can tell me the status of my case, the agents of the USCIS are changing their story, apparently I need to subtract the days when my case was on hold, and if I dont hear anything after that I should go to the USCIS local office, which by the agent's story would not help me too much ( cause my case is being processed by the National Benefits center, not a local office. I am suppose to be eligible about an interim EAD, after the subtracted days pass and I dont have any response. However they cannot issue me an

interim EAD, but they can help me with it.

Tell me, do infopass anointments help? Should I have one? What should i do?

I have been in the states for almost 7 months now, without a job, without a life, I am becoming passive and depressed, losing all my friends, every day I run to the mailbox and open my email 5 times a day, to hear any news. I have been even applying for jobs ( lying that I have the EAD, and I had to refuse some offers since i cant legaly work. My husband is caring, patient and loving but all the burden of providing from rent to bills and food is on him. This whole process has taken a toll on me, and I just want to be done with it. Please share your opinions,advices and comments. I can use some info now, cuz I feel blind def and mute at this point. Suggestions?
