help plz need to appeal i130

Hello all,

I sent in an i130 form for my dad (plz see previous post) it was denied i have less than 30 days to send in the appeal (need evidence). i sent in the application along with the money order. has anyone done an appeal for the i130 before?

Did you submit your birth certificate showing the name of your father? what about your father's birth cert. and marriage cert with your mom, did you send them together with the I130? Your birth certificate will show your relationship with your father.

Did you call USCIS to see if they will give you more time to respond? I don't know if this is possible, but at least try. You really need to get your act together. I beleive that originally you only sent the petition and money order/check. Don't just send some evidence, sent everything all at once so that there are no problems with getting it approved. Definately get the DNA test done if possible. Have you called to figure out how that needs to be completed? Good luck. And pleas read and learn everything you need to know about this process. Make sure you understand it; if not ask the questions here, but study first. I hope that everything works out.

Everyone else, Is it possible for her to refile if she runs out of time or can't get it extended?

She can always refile by paying the fee and sending the correct forms and evidence. WIthouth evidence that killed her first petition, she will be facing the same outcome. My suggestion would be to gather all evidence and only then file the new petition.
