Hello all,

I sent in an i130 form for my dad (plz see previous post) it was denied i have less than 30 days to send in the appeal (need evidence). i sent in the application along with the money order. has anyone done an appeal for the i130 before?

I think you need to give more info to get more advice here, USCIS usually send a RFE before denying an application, did you receive RFE before they deny your application, what's exactly the reason USCIS denied your I-130 Petition. You may have to consult with an Immigration Attorney about this.

I HAVE A COPY OF MY CS

MY BC (WITHOUT) HIS NAME ON IT

A COPY OF HIS BC

AND I PLAN SENDING A LETTER STATING WE PLAN ON DOING A DNA TEST BUT I NEED MORE TIME

Shinella, you are going to need more than that, as I stated in my other post you will have to create a time-line with pictures and documents to show that this person you lay claim as your father has been in your life and has performed the role as a parent. The embassy is going to request this same information, now if your father has just shown up in your life after you have become an adult, you are going to have an up-hill battle at the embassy. Yes, the DNA will established that he is a blood relative, but the embassy will be looking for both.

Who else knows that he is your father beside the 3 of you'll, you, your mother and him. Get notarized letters from them.

How often have you been back to visit him, you have no pictures? Think...Think...
