After 8 months of waiting, I finally got news that the application for my husband has been approved by USCIS and that the case is being passed on to an appellate body for further review. Apparently this is the point at which a background check is done. We have been married for 8 years, and neither of us has a criminal record. How long does this kind of thing usually take? Also, I have an appointment at the local Infopass office tomorrow, but now that the I-130 has been approved, I wonder if they will be able to help me there? Any ideas? Thanks so much for any information you can give.

No. He is in Mexico. We were married in the US, but we both lived in Mexico for the first 8 years of our marriage. I moved back to the US to set everything up last year. He is waiting in Mexico in the meantime.

well when the review period has passed the case will be forwarded to the National Visa Center where the second phase of the process will continue.

Right. That's where everything is now. Back when we applied for the visa, we were advised by USCIS not to apply for the fiance visa because they said it could delay the process of the visa. So, as a result, we didn't submit it. Now, 8 months later, we are still waiting. I guess I just want to know how much longer we should expect it to take now that the case has been forwarded to the NVC. Of course, I wish we had done things differently, but it seems there isn't anything we can do about that now. Any information would be so much appreciated.

IF there is no hitch in the process and interview scheduling is not 2+ months out for Mexico then the process could be completed realistically in 2-4 months

You have not yet applied for any visa. You are married, so would never apply for a fiance visa. You filed a petition for your spouse which when all is said and done, will result in an IR1 visa. It's at this stage, NVC, that your husband begin the process of applying for a visa, based on the approved petition.

Please update your profile to indicate IR1 instead of "other" and then click on the word "Guides" at the top of any page here and carefully study the IR1/CR1 spouse visa guide for your next steps.
