I was told that our medical exam was lost from when my husband came into the country on a K1 fiancee visa.

Therefore, they wanted him to resubmit an I-693.

I got home and read through the instructions for I-693 and it states:

2. What if I am a K nonimmigrant visa holder and already had a medical exam overseas?

If you were admitted as a:

A. K-1 Fiancee or a K-2 child of a K-1 fiancee; or as a

B. K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen; and

C. You recieved a medical examination prior to admission, then:

a) You are not required to have another medical examination as long as your Form I-485, Application to Register Permanent Residence or Adjust Status, is filed within one year of your overseas medical examination, and the medical examination did not reveal a Class A medical condition, or if you did have a Class A medical condition, you received a waiver of inadmissibility and have complied with the terms and conditions on the waiver.

b) Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original, overseas medical examination report, you will have to have the vaccination report completed by a designated civil surgeon. In this case, you are required to submit PART 1, information about you, PART 2, the vaccination chart, and PART 5, the Civil Surgeons Certification, of form I-693.

Okay, my husband was admitted on a K1 fiancee visa, we filed our I-485 in less than a year of the initial medical exam, and his examination was completely clean and clear. Based on the instructions given for the I-693 it says we DO NOT need another medical examination.

Then it goes on to explain that you need to give proof of vaccinations. At our AOS interview I showed the the DS-3025 vaccination report and gave them a copy for their own records. Which according to the I-693 is compliant and sufficient.

Now, I could go as far as having another civil surgeon fill out parts 1, 2 and 5, but is that really necessary at this point? We've done everything we were supposed to do and they lost the original... So now we have to pay someone else to look at the vaccination report we already provided them with, and have him go yep, looks okay...? What kind of game are they trying to play with us??

So, how do we proceed? We already gave them the DS-3025 and they still served us with an RFE. Do we send them another copy of the DS-3025 with a copy of their own instructions or do we pay a civil surgeon to do parts 1,2 and 5 and hope they accept that too??

They lost his medical exam from his home country (it seems to happen to them a lot). They want your husband to do another medical (not just vaccinations transcription) and submit it on I-693 (all parts, not just 1, 2 and 5).

Do you have a complete copy of his medical (or just DS-3025)? If you do then just submit a copy of it and you should be fine.

We do not have a copy of his medical. We tried to obtain one with no luck.

It clearly says in the instructions that we do not need another medical. So why are they asking for one?

They lost mine too - I had to have it redone and resubmit it to USCIS. Frustrating (and had to pay AGAIN), but I don't think we had another option.

Yes, you do not need another one if they don't lose your medical. BUT they lost it (the copy that was in the brown envelope) and there is no record of your husband taking medical exam in Morocco.

If there is no way for you obtaining another copy from his home country then I'm afraid your husband will have to do another medical.

Yes, it was their mistake but what can you really do? :wacko:

Well, I contacted my congressman's office and their immigration specialist has intervened on my behalf. She said we should have an answer by tomorrow.

I honestly think they dont "lose" all these people's K1 packets. If these things are so carefully guarded that they have to be transported in sealed envelopes and you absolutely need them to be admitted into the country, they're full of #######. I think they're too lazy to look for it or request it. They dont give us regular people the ability to call and speak to someone about our case, where our paperwork is, where it goes and what our options are. They can simply keep tacking on fees and force people to bend over and take it out of fear that their loved ones will be sent back. I'm refusing to accept that option. I'm not paying another penny for someone else's laziness or mistakes.

If you don't respond to the RFE then you will be denied the GC. Or, you can comply, pay $200, and get a new medical, and campaign after it is over. Your choice I suppose.

I will respond, but i have 30 days to fight it. The only civil surgeon in my city quote me $1300, not 200. If it was 200 i might do it. I suppose i could shop around and drive 3-5 hours away, though, i shouldnt be having to pay anything at all in the first place.

I agree with you. It's strange that only medicals get lost and not any other paperwork from the brown envelopes.

yeah I'm fed up to read everyday people saying that USCIS lost people medical! I'm in the process and I really hope it is not gonna happen to me!

please keep us informed what you congressman tells you, please please!

It is not normal they are asking this! da f***!!!!

What's the update on this? Did you have to do the medical again? Was the congressman's office able to help you out? I was told at the interview today that they also lost mine and I had to do it all over again, even do some immunizations that are not really required anymore including that out-of-season flu vaccine.

I hope that you're still on VJ and can respond to this.

2011/07/26 - AOS interview. RFE coz they LOST MY MEDICAL!!! GRRR!

2011/10/21 - finally got my GREENCARD after several complaints all over the place
