Hi all,

I lost my passport with I-94 form. I came here as an F1 student many moons ago (1994), and now I'm in a process of AOSing. Yes, I got married, and now we are preparing the AOS Package. I was wondering if I need to get a replacement I-94 form. If I do need to replace my I-94 form, what form should I file? Do I need to replace my I-94 form before submitting the AOS package?

I believe you need to file the I-102 and get a response back before you file for AOS. If you file at the same time and get an RFE for the missing I-94, and you do not have it by the alloted response time they give you, then your AOS will be denied.

You need the I-94 to file with the AOS, which you can't get till you do the I-102 and get the replacement.

If you send in the AOS without the needed forms/documentation, you will get an RFE, and will need to respond in a timely manner.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I started filling the I-102 and they had couple questions where I was not sure how to respond, but here is what I'm planning to respond and tell me if I'm on the right track here:

Current Immigration Status: F1 Overstay

Status Expires on: D/S

I-94,I-94W, or I-95 Arrival/Departure Document #: ??? - Note that the instructions said that you write "N/A" if you did not receive Form I-94 at entry, which in my case, it's not true because I was given an I-94, and lost mine with my passport and I don't have a record of that number.

Anyone has any suggestions here?

The best two ways are via a FOIA Request with CBP or the I-102.

Normally CBP will respond to the latter with your I-94 info but you will need the right date of entry.
