AOS (GC) from F1- married NYC

Timeline

Hi friends,

Here are some details of my case:

-I was married to my USC wife last June 2010.

-We filled all the requirements Oct 22.

-Got NOA Oct 28.

-F1 status expired Dec 4.

-Biometrics Dec 9.

-Got my EAD card Jan 7.

Now, I am still waiting for an interview date. Every time I got USCIS website and check the status of my application it says: (1) initial review for I-130 application; and (2) YOUR APPLICATION CANNOT BE FOUND for I-485. I called USCIS twice already and at both instances they told me that there is something wrong with their website/system but my application is in order and is still in review.

***In the light of all the factors, should I be worried that I haven't gotten an interview date yet when I filed in October?

***Was the fact that my F1 status expired a big issue?

*** What can I do at this point?

***Anyone familiar with the timeline for cases like mine in NYC?

The online system is not reliable. If you got an NOA1 for the i-485, then you are all set. Overstay is irrelevant/forgiven for spouses of US Citizens. I have heard that New York has been slow lately.

So no, there is nothing to worry about. Good luck.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

5/23/12: Sent out package
2/06/13: APPROVED!

No overstay has been accumulated since you submitted the AOS before your F1 status expired. New York seems to be taking longer in processing times than the nation wide averages, especially with sending interview letter and scheduling the actual interview date.

Adjustment of Status from F-1 to Legal Permanent Resident

02/11/2011 Married at Manhattan City Hall

03/03/2011 - Day 0 - AOS -package mailed to Chicago Lockbox

03/04/2011 - Day 1 - AOS -package signed for at USCIS

03/09/2011 - Day 6 - E-mail notification received for all petitions

03/10/2011 - Day 7 - Checks cashed

03/11/2011 - Day 8 - NOA 1 received for all 4 forms

03/21/2011 - Day 18 - Biometrics letter received, biometrics scheduled for 04/14/2011

03/31/2011 - Day 28 - Successful walk-in biometrics done

05/12/2011 - Day 70 - EAD Arrived, issued on 05/02

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

You should be posting and reading here: http://www.visajourney.com/forums/forum/130-adjustment-of-status-from-work-student-tourist-visas/ as you are AOSing from an F1 visa, not a family visa.
