Hi friends,

Here are some details of my case:

-I was married to my USC wife last June 2010.

-We filled all the requirements Oct 22.

-Got NOA Oct 28.

-F1 status expired Dec 4.

-Biometrics Dec 9.

-Got my EAD card Jan 7.

Now, I am still waiting for an interview date. Every time I got USCIS website and check the status of my application it says: (1) initial review for I-130 application; and (2) YOUR APPLICATION CANNOT BE FOUND for I-485. I called USCIS twice already and at both instances they told me that there is something wrong with their website/system but my application is in order and is still in review.

***In the light of all the factors, should I be worried that I haven't gotten an interview date yet when I filed in October?

***Was the fact that my F1 status expired a big issue?

*** What can I do at this point?

***Anyone familiar with the timeline for cases like mine in NYC?

Once you received your NOA1 you are no longer seen as F-1 student, rather you are now AOS Pending. Don't worry about the online system not working - it's completely horrible and rarely up to date.

From what I understand NYC is very busy so I'm not sure if your case and interview letter are lagging behind others or not. At least you have your EAD :thumbs: so you can work while they putter along at a snails pace.

If you want piece of mind, you can try calling USCIS again and ask to speak to a higher level officer.

But the key is here not to worry, you are here legally, you have your EAD so life is good! :thumbs:

12/23/2010: USCIS Receipt notice for I-485/I-130/I-765/I-131
01/05/2011: Successful biometrics walkin at Charleston WV office!
03/04/2011: EAD and AP combo card in hand.
04/21/2011: AOS Interview at Norfolk local office. APPROVED & Card production ordered!
04/25/2011: Welcome to the US letter received in mail.
05/02/2011: Green Card arrives in mail!

01/29/2013: NOA received for I-751 form submission (joint)

02/22/2013: Walk in biometric (appt. for 03-05-13)

06/25/2013: I-751 approved!

06/29/2013: 10yr Green Card received in the mail!

08/18/2015: Mailed N-400 application

08/28/2015: NOA for N-400

09/14/2015: Biometrics appointment for N-400

02/02/2016: Interview for N-400. APPROVED!

02/18/2016: Oath ceremony!

Does not having a lawyer make a difference on the process/ processing time?

Depends on the case and how difficult it is.

(also on how well you can read/submit forms)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
