oooh y ?? :crying:

because your case MUST be current before you are able to travel on the Immigrant Visa.. Now is you are making reference to the "Tourist Visa" also known as the B1/B2 Visa then yes by all means you should apply. You will need to show proof of having strong ties to your home country and having no immigration intent. If you are asking about the tourist visa then please clarify so that we can provide the information accordingly.

You can apply for a tourist visa, you must show strong ties to your country as anyone apply for a tourist visa is considered to attempting to immigrate until proven otherwise.

What you cannot do is obtain a visit visa and overstay in the US and adjust status here.

I am planning to apply for tourist visa before we fill our I130 (within this month). My husband is greencard holder and I am foreigner. We are married for more than 3 years.

Is there really no chance to enter USA on tourist visa and adjust status there? Any legal option to stay there when already entered on tourist visa?

Thank you!
