Thanks for your help guys. It's nice to know that I'm not the only one going through this #######.

And you know it will be several months AFTER he arrives before he can work. Yes? K-1s are NOT eligible to work until they have an EAD or Green card, anything else you heard was wrong. This means get married, file for AOS and WAIT again for USCIS.

Of course the wedding plans are not going to get you expedited, USCIS & the Embassies all warn you to not make any plans until after you actually have a US Visa in hand.

Regarding the business, why can't he just complete the sale regardless of his Visa timeline? Does the buyer require he move out of country as a condition of the sale?

Regardless, expedites require the hardship (financial, health or otherwise) to be on the US Citizen's side.

Just to clarify. The wedding stuff was in addition to the business expedite and job offer here. We originally submitted the expedite with both as evidence and it was denied. So my congressman resubmitted one based on the business alone. The thing that is the issue is that if he sells it now and waits he will need to get another job as supplemental income until the time he can come here. It is better for him financially to hold onto the business now but will probably have to dump the price to get it sold quickly. Also, his job offer needs him here in the summer to get trained and such but now we have to let it go too.

I understand about my lawyer and I am incredibly disappointed with him. I wish I would have found this site too. Fortunately, it was a base price and I am not getting charged more for the expedite. This whole situation sucks and I wish CSC would just get the things done. The thing that bothers me is that they don't give us a reason. If they did we could possible come up with more evidence to support it if needed.

K-1s are not eligible for expedites. That is the rule. They will occasionally make an exception for a US serviceman who is being deployed to a combat zone.

NEVER make plans requiring any money deposits (unless you are prepared to lose the deposit) until the visa is IN YOUR HAND. The process can be delayed for may reasons or no reasons at any time. The approval of the petition is only step one. After that is the NVC which can and does take many weeks sometimes and then the consulate which can take days or take months.

K1 expedites have also been granted due to the health of the petitioner.

That lawyer was selling things which could never be done. In my opinion he should, at the very least, reimburse you the money you paid him.

N400 Timeline:

12/14/11 - Sending out N400 package

12/19/11 - Received by USCIS

12/21/11 - NOA date

12/22/11 - Check cashed

12/27/11 - Received NOA

02/06/12 - Received yellow letter (pre-interview case file review)

03/13/12 - Placed in line for interview scheduling (3 yr anniversary)

03/17/12 - Received interview letter

04/17/12 - Interview - No decision, application under further review

04/17/12 - Biometrics

04/25/12 - Placed in line for oath scheduling (so I'm approved yay!)

04/27/12 - Received oath ceremony date

05/09/12 - Oath ceremony!!

K1 Expedites are extremely hard to come by. The only time I've seen one was health of the petitioner and even then it was rare. There was a member here who had been trying to get an expedite done, as her process was stuck in limbo. Her health would not allow her to visit her Non USC SO, and with all the delays etc, she no longer fit the requirement of "meeting your fiance in person in the last two years". Suffice it to say after 5 years or so, we no longer see her around these boards, and I believe they gave up any and all hope.

Granted this is an extreme example but it is to show that even in dire straits, you wont get one unless possibly if your Military USC is about to Deploy.

USCIS states on their site if its due to their error they will expedite but even then they wont. My lawyer originally told me 3 months. well 3 months turned into 6 months, and then USCIS made an error adjudicating my petition, which caused NVC to send it back to USCIS. that added on another 5 months. Finally after almost 13 months ( yes over a YEAR) i finally had my interview. And i had requested 2 expedites after they told me on the phone i was eligible due to their (uscis) error.

Sorry, but they do state Never to plan anything in advance on all the paperwork and on the guides. You may just lose all that money.

A quicker option may be to get his prospective employer to sponsor him for a work visa.

That is not true, we were just approved for the expedite of I-129f, got an email on March 29, 2011, and letter came March 30, 2011. We had a compelling medical and financial reason for the expedite to be approved based on US fiancee's condition.
