Hello All.

I was granted a K-1 visa and am already in the US. About a month after I arrived, we opened a joint bank account with my fiancé. I had to fill in a W-8BEN form, because I am not a resident yet. As I put down my US address, they made me fill in an additional sheet for "Reason for U.S. address". They list several options, like F or J visa holder, but nothing for K, just an "other" option that you have to explain. I wrote K-1 holder marrying a US citizen, which was fine according to the banker. I got my card in the mail the next week and everything was fine until yesterday when my card started not to work anymore. Today I got a letter from the bank saying that the reason for the address I gave was not accepted. I can't find any better options. I tried to find out more of this W-8BEN form and looks like this is for establishing that I am not a U.S. person, although I am not a resident of my country of citizenship anymore either. I am before getting married and AOS and seems like I have no status at all. Does anyone have any idea how could I resolve this problem?

about 2 weeks after you came into USA, you could hit any SSA office and apply for SSN.

Suggest you look into that, soonish.

I do have an SSN. But they had to options: filling in the W-9, which is for residents or the W-8BEN which is for non resident aliens. I guess I am neither of them really. But the woman at the bank made me fill in the latter.

please pursue your SSN at a SSA office - it's a benefit of a K-1 visa holder, as long as it's not 74 days past yer POE date.

then the W8BEN form should not have been used, at all.

SSN and passport were sufficient - yer banker is an idiot.

We had to fill out form W-8BEN as well eventhough I had a SSN already. I did the same you did- I checked "other" and wrote K-1 visa holder. No problems with our bank but we were married at that time already. Maybe that made a difference?

What bank did you go to? Be nice to know for others so they can avoid that issue.

I went to bank of America, brought my passport, marriage licence, drivers licence, and had a joint account opened about a month after moving here. You are allowed even if your not a resident to open one, you just need your passport. Your bank is "stupid" as others have pointed out. I suggest you go somewhere else. Most of the Big banks don't have issues with Non us-citizens opening accounts.

We went to Chase. They were nice and all, didn't seem like they can't handle it. Maybe it made a difference that you were already married, as we are not yet.

Still doesn't matter..any Non us citizen can open an american bank account. Plenty of people on here have done it. Quite a few people in the Canada forum opened accounts with just their passport when they were down to visit their us fiance. Maybe it was just your branch, as i did a search and Chase does offer Non us citizens bank accounts on their website.

Heck my bank still has my canadian address on it as i have been lazy in going in with my green card to change it lol.
