Sorry man, if one is activism then so is the other. IMO neither is. The SC is the final say over what is or isn't constitutional. They cannot be, by definition, an activist.

Again, I'll ask you to actually look up what judicial activism is, you seem to be misusing the term quite a bit

I looked it up. I still have the same opinion. The second ammendment is clear, "A well regulated militia being necessary to the security of a free State, the right of the People to keep and bear arms shall not be infringed."

A militia is defigned as:

mi·li·tia (m-lsh)

n.

1. An army composed of ordinary citizens rather than professional soldiers.

2. A military force that is not part of a regular army and is subject to call for service in an emergency.

3. The whole body of physically fit civilians eligible by law for military service.

The second ammendment clearly calls for a "well regulated militia". The definition of Militia is "An army composed of ordinary citizens rather than professional soldiers." then the rights of citizens, or as the ammendment calls them, "the People" to bear arms cannot be taken away. There is no activism there. There is no ambiguity there. It is clear and well defigned.

Now if you want to talk about activism, address Danno's point. Show me where the right to an abortion is spelled out. Clearly that does fall into the catagory of activism. However, I still maintain that the SC cannot be activists since they are the ones that have the final say.

Gun nuts only love the word 'militia' in the phrase 'well regulated militia' any attempt to 'regulate' is met with over the top accusations of rights violations and whining about liberal/lefty plots.

Not all gun enthusiasts are "nuts", some of us actually support reasonable regulations. ;)

I personally have no desire or use for a gun so I don't have one. Here on VJ though, saying guns are dangerous can get you slammed as a mamby pamby.

He does have a point Charles. I think it's a case of histrionics if you think people are calling you a gun nut for having a single weapon. If they indeed are, I would suggest the same diagnosis to them. I don't have a problem with owning weapons for sport, or even home defense. But do we really need banana clips? Piercing rounds? Assault rifles? Despite the best efforts of some misguided and misinformed people, the point of the 2nd amendment isn't as a check against an overbearing government.

some people do consider you a gun nut for having just one firearm. as for banana clips, what do you consider to be one? by piercing i assume you mean armor piercing? and just what is an assault rifle? this maybe?
