My husband of 6 years is German, I'm an American citizen and have 3 children who are also citizens. After giving it a go here in Germany I realize that it just isn't going to work for us, too many cultural differences that I can't come to grips with and way too many limitations for mobility. I had already lost my left leg below knee in 98 (in the states) and last year lost the right (here in Germany).

So, in a large nutshell: my husband is self employed here in Germany and co-owns a 100 year old building company. I have recieved SS disability for something like 20 years, and still receive it. Our savings are around $100,000 usd, plus capitol in the existing building company, and land in Germany. My own income is well below the poverty level of the states but I believe our assets compensate for the difference. Does anyone know of special circumstances where a visa is approved for a spouse of a disabled citizen without someone co-sponsoring? Also, my income was always below the amount required to file a Federal Tax return and now I'm in panic mode realizing I have no tax returns other than my husbands German tax returns! No, I didn't file a return out of the country either. I don't know whether to contact the IRS or just go to the initial K3 pre interview and discuss the issues there. Obviously I don't want to inadvertedly shut any doors before I get one wheel through!

Can anyone help??

Actually, I'm not aware of any special dispensations. Having lived in Germany and earned under the required figure to file US tax returns, you should not be required to provide them and can simply note that you had no requirement to file US tax returns on your submission.

You've done a lot of research--good on ya! You missed one valuable pointer though, something called DCF/Direct Consular Filing on the internet (the Consulates don't call it that, which is how you missed it).

You do not have to use the US filing and/or K-3 filing--you may lodge your I-130 directly in Frankfurt.

On the face of it, it appears that your assets would be sufficient to cover the sponsorship issue, but I urge you to look into 'domicile' as well. There is a Guide to DCF here that might explain things more fully: http://www.visajourney.com/forums/index.ph...om&page=dcf

You will have to get your US taxes cleared up; the IRS is much more helpful than the CIS. You should find overseas help at the Frankfurt Embassy's website (click thru to Field Offices from uscis.gov).
