Tax Returns for I-864

Hi,

Me and my American wife have just filed our I-130 and now trying to get ready for the next stage. Fingers crossed there is no RFE.

Just looking at the I-864 my wife has to complete. Its asks for tax returns for the recent year and optional to submit last 3. We would like to submit all the info we can which we believe will help as we are quiet young(ish). Me 27 and my wife 25.

Only thing is my wife has only been in work 2 years, as she was a student before. Do we need to say this anywhere? will it matter we only have tax returns for 2 years?

You only need to send in recent year and that's it and as said before as long as her income is above the poverty line you are sweet. Yu don't have 3 years tax return so recent year is fne

I had the same issue. I was the full time student for 2008 and 2009. Thus I files I-864EZ and only included this year 2010 tax return with 6 months of paystub and employment letter. I called NVC and they told me my AOS has been accepted.

$44,000 is great. With that kind of income there is no need for any evidence other than the most recent tax transcript. Past year tax information is more useful when someone's most recent tax return shows a lower income, but they feel the previous returns will help show that their prediction of income for the coming year is valid.

On the I-864 where it asks you to list the income on the last three tax returns, if the third one was when she was a student then you can always write in parentheses "student" if it makes you feel better.

I only submitted my 2010 joint tax return to the NVC, and the I-864EZ was accepted with no problems. As long as you are above the I-864P guidelines, then only the CURRENT year is required. You can submit 2009 if you feel it will help your case to show continued employment.
