Sorry to hear this. I think marriage and file CR-1 maybe the next better option. Because if they refuse, your spouse can at least sue the State Department, let them prove why in court, because your wife has the legal right to be with her husband. If you don't mind asking you, what is the age gap between you, and also any previous marriages?

I would do as others have suggested: contact your senator/congressman. Try to contact them today by phone/email(both). Always advisable to write a detailed account of the questions asked and how they were answered. It should include everything. Also compare the interview with the facts presented intially. Start to compile more evidence. Pray hard for guidance. Knock on every door that you can to get detailed information. I pressed on and got specifics on our refusal. Plan a time when you can visit again. I am sorry to hear of your refusal. Try to remember this is not a final denial, just a refusal. Do not give up!! I will pray for your situation. You have a friend here.

The CO made it clear to the OP to get married and file for Spouse visa, they suspected that he just wants to come to America, so the better thing to do now is to get married and file CR1, bring in more evidence or contacting Senator/Congressman wont do any good. Case might be in the returning pile right now. They can file an appeal but it'll take more time than if they get married and file for spouse visa.

Consular Officers are usually firm with their decisions on these type of visa that aren't for immediate family of a US Citizen.

The OP can do whatever he wants, but this is usually the best thing to do. specially when the CO gives a clear path to take.

Just want to say that the consular officer told my hubby the SAME THING....get married, I will issue you a visa....fast forward 14 months, cr-1 interview by a woman, but with the SAME MAN right behind her, looking over our file, and talking with her....denied again. I would not believe everything the consular says

I think your Hubby might have missed understood, they don't usually tell you to get married and come back for the visa, they might tell you get married and come back with more proof if they are not convince about your relationship to give a k1 visa.

What is the reason they denied your husband once again?

No one can guarantee a visa approval even the CO himself/herself.

Excuse me sir or maam, I was just responding to what you said here in bold. I OBVIOUSLY know they can not guarantee a visa, but my point was, he DID say the same thing he said to this man, and it wasn't true. Not once did we think we were getting a visa based on what this guy said, we knew he was just flapping his gums. I was just making it clear that you shouldn't do something just because the consular officer suggests it. It means nothing. Just getting married will NOT void what happened at the k1 interview, and if you don't know the specifics of the denial, it is treading shark infested waters. OP, please make sure to contact your senators. Even if it may be fruitless, there is always a chance. Best of luck to you

PS...we were denied because she didn't believe our marriage was based on love

Regardless of the type of visa requested, K-1 or CR, now is the time to reflect, plan, stradegize. Time is of the essence, create a detailed account of the interview, gather evidence, and seek counsel. Casa is very difficult.

I am so sorry to hear about these denials today...........you all are in my prayers. We were denied K1 in Oct 2010. I still have not heard back from USCIS regarding the case. It did take 15 weeks to let from Casa to the states.....really?? We decided to get Married, I went to Morocco for 2 weeks and got married on March 1. 2011. Here we go again, CR1

tany1157, wow! GOD bless you both.

AND I KNOW WOMEN WHO ARE SAME AGE WHO GOT A VISA AND I KNOW WOMEN WHO ARE MUCH MORE THAN 12 YEARS OLDER THAN THEIR MEN AND GOT A VISA...........I KNOW WOMEN WHO GOT IT INLESS THAN ONE YEAR AND SOME WOMEN WHO ARE WAITING 3 AND 4..............ONE THING DEFINITELY..............YOU K1 WILL EXPIRE..........AND WHEN IT DOES U WILL HAVE TO START OVER (REAPPLY)..........THE CR/IR1 DOES NOT EXPIRE......MY HUSBAND ALSO GOT THE 221 G BULL ####### PAPER...................OUR PAPERS ARE NOW AT IMMIGRATION WAITING FOR REVIEW...........AVERAGE TIME FOR THIS IS 6 MONTHS.............CURRENTLY I AM GATHERING MORE PROOF/EVIDENCE OF ONGOING RELATIONSHIP............PICTURE......PHONE LOGS...........TEXT MESSAGES TO MY PHONE FROM HIS AND INSTANT MESSAGES FROM ALL THE DIFFERENT PROGRAMS WE USE...........ANYTHING THAT SHOWS WE STILL HAVE LOVING ONGOING RELATIONSHIP..................

when the CO tells you that you can refile for CR-1 it means the chances of any k-1 petition ( even if you file another one ) are low,i would listen to him if i were you,and try typing with caps lock off next time, maybe show some respect to the guy who is only doing what he is told to do?its not like he didnt like you or denied you based on personal feelings

WHATEVER................THEY PICK AND CHOOSE WHO THEY WANT TO GIVE A VISA TOO..................IT DOESN'T MATTER WHAT EVIDENCE U HAVE OR HOW LONG U HAVE BEEN MARRIED OR THE AGE DIFFERENCE............THEY CHOOSE WHO THEY WANT TO GIVE A VISA TOO AND MAKE THE REST FIGHT FOR YEARS..............IM IN THIS PROCESS NOW AND I KNOW HOW THEY ROLL.......THEY ASK SOME COMPLETELY STUPID QUESTIONS KNOWING THEY CANNOT ANSWER JUST SO THEY CAN BE TOLD NO!!!!!!!!!!!!!!!!!

WHERES THE PART ABOUT SOMEONE BEING DISRESPECTED............I MISSED IT....................WHO WAS DISRESPECTED???? I DIDN'T READ WHERE A CO WAS DISRESPECTED

from my observations, this seems to make a lot of sense...a big part of the approval might have to do with luck as much as evidence in some cases... sorry to hear about the denials, maybe something good will come from them in the long run.

Just to say I'm sorry about what happened to both of you (fiance and spouse) and that I hope that you get out of this mess soon and are re-united to your loved ones.

As I'm sure you all know, Morocco is unfortunately top of the list for visa frauds (i.e. people doing anything to get a "ticket" to America), so it is a reality ConOffs there face on a day to day basis. I'm sure they've grown ultra suspicious of every intending immigrant they see, which is probably why their judgement is clouded and they end up denying even people who are in bona fide relationships.

I really wish you best of luck in proving your true intentions - remember, the truth always finds a way to shine in the end!!
