F2A-issue Please Help!

Hi

I applied for my son on F2A (PD 9/2009). Current application Status: 'SIF'. Last 5 months 25 days I am out of USA and staying with my little son. I had a return ticket to fly USA tomorrow. All of a sudden my brother died. I want to stay little bit longer.

Is there will be any problem in terms of my pending F2a Application? (for staying more than 6 months out of USA)

Is there will be any problem in terms of citizenship or any other entry problem? (I don't have travel permit)

I would really appreciate your thought and input in this regards

As an LPR you can stay out of the country for up to 11 months. So in this case if you need to take a couple more months to stay out that should be ok! But I recommend to make it as short as possible. The less time you stay out the better.

You may be found to have abandoned your permanent resident status if you:

Remain outside of the United States for more than 1 year without obtaining a reentry permit or returning resident visa.

Hence my point.

If you speak to a ;lawyer make sure they have actually tried abandonment cases. Most have not.

I'm sorry to learn of this life changing event. Just how much longer are you trying to stay. As mentioned before you may stay outside the USA for under one year and I with spending time with your young child and a death prior your departure and you should say30-60 more days I think that is justified. Many funerals overs seas does just happen like in this cold country .. so there's no 4 days after funeral. If you feels a re-entry permit is necessary to apply you must be inside of the USA when you apply but again if would be useless if u would only travel there for 1-2 months.

As it relates to your application no, as long as your domicile is still in the US.

When you travel outside of the country for more than 6 months and it was not on a special arrangement like say military then yes it would affect when you are able to apply for your citizenship. When are you when would you be eligible to apply for your citizenship would be something you'd want to consider?

hi guys! i filed I-130 F2A ON OCT2010 . THEN I GOT RECEIVED APPROVAL ON MARCH9. THEN NOW I RECEIVED A MSG ON MY EMAIL OF MY NVC CASE NUMBER.. SO WHAT SHOULD I DO NEXT? ANYBODY CAN SHARE SOME EXPERIENCED FOR THIS CATEGORY. THANKS IN ADVANCE!
