Hello

question on the I-864 # 23.... Current Annual Income. Can I just use my w-2 from 2010 amount? Or should I use my base pay on my letter from employer? My base pay does not include my OT. Both amounts are way over the 125% poverty but just want to make sure I use the correct income since I will be submitting both letter from employer and IRS transcripts.

Timeline

I used bottom line of tax return, and it was OKed by lawyer. I am self-employed and wrote myself a letter (he he he). My numbers are very different. (about double.) I, too, am over the limit, significantly. I just included extensive documentation. (Mine is an I-134). I was told to include 3 years tax returns, or would be denied, even though the website says 2 years, FYI.

Write your expected income for 2011. As you are way over the poverty line however you look at it, you need not sit down and try to calculate this in any complicated manner. Look at what you earnt in 2010, consider whether there will be any huge differences in 2011, and then put a round number down. (As in, we just put it to the nearest $5000 as it was an estimation based on unknown factors. So long as you are sufficiently above the poverty line they do not care about how you reached your answer.

A tax return isn't complete unless you have a tax return and a W-2, or you an do a tax transcript from the IRS. But I wasn't asked for them by the lawyer until now- readiness for Embassy. (I have heard no good answer on whether the e-filed copies should be signed, though. I did, and dated them the day they were filed. Hope that was right.)

W2's are not required if you are sending IRS transcripts. W2's are required if you send tax RETURNS.
