Hello VJ ,am here agAin asking your knowledgeable idea about my situation . I came here as spousal visa and have 2 year green card. I'm going to remove my 2 year green card next year but my husband passed away yesterday and I really don't know what I'm gonna do..can I apply ROC early since my husband is already gone .? I really appreciate any info .

Sorry for your loss Princess. Since the removal of conditions doesnt happen till next year, I'd advice you take a bit of time off VJ and mourn your husband and gather your thoughts. Things will work out fine for you. Sorry again.

My condolences to you, I'm so sorry.

As Mrs. O said, take some time to mourn for your husband and come back on VJ when you're ready.

On the Removing of Conditions document (I-751) via the USCIS site, it specifically has an area on the form where you can say that the sponsor/your husband is deceased and you are asking for a waiver.

Yes, you can file to remove the conditions on your green card as soon as you receive copies of the death certificate. While you would normally wait until 90 days before the current green card expires, death of the spouse is one of the reasons where you become eligible immediately to remove conditions.

You would file the I-751 petition, http://www.uscis.gov...00045f3d6a1RCRD include evidence that shows the two of you shared a home and your finances together, and then include a copy of the death certificate. There is a place at the bottom of the form that you would check off asking for a waiver from 'joint filing' due to the death of your husband. I know you are grieving and everything will be overwhelming for you right now, but you will want to take care of this before next year. Again, please accept my condolences.
