confused about I-797C Notice of Action

Hello Everyone if somebody got troubles with EAD application or get the file back because of wrong fee in the check you might help me with some advice

here is my situation:

I sent my file march 3

I got 3 e-mail notifications on march 23 (I guess one for each form: I-130,I-864,I 765)

at this point I have to tell you a mistake I did : when I sent my file I sent a check for every form.and after send my file I found out I do not have to send a check for I-765 EAD employment authorization document so I knew I will get that check back.

on march 26: I got my check back with a I-797C Notice of action.

here what it says:

notice type: Rejection Notice Notice date:march 23,2011

Recently,you submitted an application for immigration benefits.That form was submitted with an extra remittance that is not required to process your application,your check is being returned to you with this notice.No additional action by you is required at this time.

Please be sure to complete the application fully,submit the appropriate fees, and include all required supporting documentation.

if you have any questions about possible immigration benefits,filing information,or USCIS forms please call the USCIS

you will be notified separately about any other case you may have filed.

questions:

does it mean my EAD application was rejected?

do I need to submit my whole file or only the I-765 again?

also I got a green sheet of paper saying that I'm invited to resubmit my application and put that green sheet of paper on top of my package.so do I have to resubmit my whole package? but in the I-797C says no additional action by me is required at this time

I do not know... it is so confusing...I gonna call USCIS but I would like to get some advice for you or if you were in a situation like this...

Yes, your I-765 was rejected. You can send the whole thing back with no fee and a copy of your NOA1 from the I-485. It says you don't have to do anything because you don't, if you don't want an EAD. If you do want an EAD, you are invited to resubmit your application for I-765. The other applications were not affected.

I am facing the same problem. I'm currently on H1B with my company. I got married in Sept 2010 to a US Citizen. On June 24th 2011 I applied for i-485 & i-130 along with a plethora of forms that were required. On 8/6/11 I received i-797c. All it says under notice type "Rejection Notice". The box where the receipt number should go is blank. Attached to the Notice of action is a check which I had sent for $88.00 for i-864 affidavit of support. The i-797 c states:

" Recently, you submitted an application for immigration benefits. That form was submitted with an extra remittance that is not required to process your application. Your check is being returned to you with this notice. No additional action by you is required at this time.

Please be sure to complete the application fully, submit the appropriate fees, and include all required supporting documentation"

I am at a loss of what this means for me?

Does it mean that the rest of the documentation was fine? Do I have to file for i-485 & i-130 again? Do I have to pay all the fees all over again?

I have scheduled an infopass appointment but somehow I feel that is going to be a waste of time. On the uscis website under form instructions it does mention that there is no fees for this form. I am assuming that is the reason they probably returned the check. What I don't understand is why didn't they provide me with a receipt number. Furthermore, I have also a fluorescent green paper saying:

"Dear Applicant,

We are sorry to inform you that we have rejected your application for the reasons indicated on the I797 Reject notice.

You are invited to resubmit your application after you have corrected the reasons for rejection. If you have any questions please contact lockboxsupport@dhs.gov."

If you got the whole thing back, then you need to resubmit everything you have with the correct payment. You do not need to pay $88. You need to pay $420 for the I-130 and $1070 for the I-485. No other payment is required. Please read the instructions on the forms for the correct fees. Did you get everything back or just the check for $88?

I received my I797C rejection notice today , receipt date Sept 14th , 2011

The reasons are the same which have been mentioned by ARORAMIT

Could anyone in this grp tell me wht happened to your cases and guide me.

Did you send an incorrect fee with one of the forms? If so, which, and which forms does the Rejection Notice include?

Hi

Yes i sent and extra check for $380.00 along with the I765, even though i filled it along I-485 ( amt of $985.00). so they sent the amount for $380.00

I understand that if file it concurrently i765 along with i485 there is no need for$380.00. Also in the Rejection notice i don't see any Alien Number or Receipt Number

I called the customer service they mentioned that i will have to wait for 30 days to see if i receive back the form along will the supporting docs i submitted.

Please advice.

If you get a green sheet - staple your application behind it and re-submit. Without a check!
