Hi,

I am confused and need help PLEASE. Do I need a waiver for the second I-129f where the first one was approved a year ago by the USCIS and my fiancee was denied her k-1 visa at the embassy? I want to file the second one recently. USCIS closed the first petition and send me a letter clearing me to file another one. Please help me any suggestion is valuable. thanks

Yes unfortunately your application is within the two year limit. You just have to write a letter signed and dated stating why they should let you file it within 2 years and any supporting evidence like a copy of your past approval and any other evidence you have, along with your I-129F package.

Edit: I'm assuming this will be your 2nd application. If its more than that you'll have to give them reason for going beyond the IMBRA filing limitations.

Hopefully you have fixed the problems of why your fiancee was rejected the first time.
