Hi! I recently got married (A little over a month ago) and we're in the process of filling out all the necessary packages. (It's a bit confusing, filling out all the forms, but that's for another post. :D )

Anyway, I just saw the movie "Green Card" with Andy McDowell and it got me wondering, besides the required forms, do immigration officers (or INS representatives) still make home visits? Has anyone ever had any experience on this? (Yes, I know that movie is so old and most likely, outdated but, still.)

Thanks!

Yes, I have heard of a case when INS came home to somebody's house. They were married and he came here on a K3 and did not do Adjustment of Status yet. Their marriage did not work and they visited him and told him to go home in 30 days. I am not sure if it is true though.

Why are you asking?

A friend of mine who had a Green Card got visited a couple of times by INS officers. He was a dodgy case though, as he lived in the USA illegally for 8 years before getting married and applying for his green card. However, his marriage was real (they're a great couple, love them to bits) so he didn't have anything to worry about. However it definitely can happen.

wouldn't it be easier that way? After all, where can you prove your relationship better than in your own home? With the pictures hanging, the personal stuff, the clothes, ...

never heard of it..

Regardless, it does happen.

More often than not, the home visits from the USDOJ are related to immigration benefit fraud, however, marriage-fraud investigations are conducted where the Service deems fit. While it is not completely out of the ordinary for these impromptu visits to occur at any stage in the process before the permanent residency without conditions is conferred, they are more likely prior to the adjustment of status approval, and are prompted by certain discrepancies, information or if the office has reason to believe that the parties' comportment is not as man and wife. Comporting as man and wife, is not the same as living in the same residence. There are situations when an alien and his/her spouse may not live together for some time, due any number of reasons to include to professional or educational pursuits.
