Hello Everyone!

I don't know if this will be a problem in our case. But my fiance and I have the same last name, Nguyen. I have a strong feeling that HCMC will want to see both of our parents birth certificate to check whether or not we are related during our upcoming interview. We are not related of course, since there are so many Nguyens, Trans,etc...

My question to you is this, my parents immigrated here in the late 1970s and had lost all of their papers, but luckily they still have their Marriage certificate. In case, HCMC asked for my parents' birth certificates, can I tell them to consider their Marriage Certificate instead, since there's no way that we can get an original birth certificate for the both of them. Since the Marriage Certificate does legitimize my parents' parentage. thank you for all your help! :D

This issue actually does come up from time to time... sometimes the CO accuses the petitioner and Beneficiary fo being realted.. cousins or something... another member actually was accused of this and his wife was banned for life due to the accusation not being responded to appropriately... so dont take it lightly if it does happen

There are some options when it comes to getting birth docs but usually the immigration docs of the parents are sufficient...

Oh boy, this doesn't sound too good. But if there's no way that we can produce an original birth certificate, they should at least consider my parents' marriage certificate though, because this is the only original document we have that prove my mother and father's parents are not the same as my fiance's.

So do you happen to know what they told your uncle? Did your uncle's fiancee fail the interview 4 times because of not having the birth certificate? What's going on with your uncle's case now? Thank you for your input! :thumbs: It really helps!

What types of immigration docs do you mean? I mentioned that when they immigrated, they lost all their paperwork from Vietnam, they only have their original marriage certificate with them.

From my understanding, HCMC probably wants to see whether or not both my parents and my fiance's parents are related or not. So in the marriage certificate it does contain the names of my mother's/father's parents names, so isn't this sufficient evidence that, we don't come from the same family line.
