Affidavit of support (form 1040 or tax transcript)

Hi Everyone!

I'm sure this topic had been discussed before, but I wanted to make sure that I have my information straight. I have read that some people said attaching form 1040 to their Affidavit of Support was acceptable, while others say that HCMC wanted a tax transcript from the IRS. So can someone please let me know, which is correct, form 1040 or a tax transcript? I'm doing the K-1 fiance visa. Thanks for your help! :help:

Tax transcripts are the way to go... you can get them really fast through the IRS phone system... usually just a few days...

Bring everything and let them tell you what they want from you on your interview day. I gave my fiance my Tax Transcript, W2 and Tax Returns. Once it's your fiance's turn at the window, they will ask you what they want. Bring tax information from the last 3 tax years. It's better to be save then sorry. It turns out they only wanted to Tax Transcript from my fiance but it wouldn't hurt to be over-prepared. Good luck :)

The CO's (and USCIS) prefer tax transcripts over copies of tax returns. Plus with the transcripts there is no chance that you may mistakenly not include a portion of your return and supporting documents.

reading this thread, i went online to request a copy of my tax transcripts...but it's not available? maybe my tax return is not in the system yet or my employer hasn't filed?

i'm expecting our interview date to be in may so i still have a little time.

Ive used this in the past for another reason & I have recently ordered my 2009 tax transcripts for the K1 interview. I was waiting to file my 2010 taxes til April 15th, since I owe. But I am gonna go ahead and file it now, so I can get the 2010 transcripts ordered soon. HCMC seems like possibly one of the most picky consulates on the planet, so trying to cover all the bases.

We are about 1 month behind you, so I got my eyes on your timeline. Good luck B-)

Employers don't file tax returns (for their employees), individuals do.

don't know if it makes a difference but i got a 1099. i'll talk to my tax guy again and will call that number (closed weekend). i filed where the irs would automatically deduct the amount owed from my bank (which they did last week) so not sure about the delay. i tried to order the transcript online but they couldn't find it.

i called DoS on friday and they told me HCM just entered into the system that they got my DS 2001/230 that day. just waiting on the packet 4 now. that DoS #s is a godsend...HCM moves at a slug pace when answering your emails and they don't answer anything through the phone.

i agree with cedwards. we had our interview a week ago and they only took the 2009 tax transcripts, 2009 tax return, and 2009 W-2. we had 3 years worth of stuff but they only wanted 2009. bring 3 years of stuff because you never know.......

would be bad news for me as i didn't work in '08 or '09? what happens in the cases where you don't have those docs?

nope, according to the new law. They only look at the most recent year of taxs return. If your most recent year tax returns don't meet minimum requirements then they look at last six months. What they're trying to do is make sure you your wife/fiancée will be ok and taken care of.
