Hi to all

We are one of the couples that are over the 5 months timeline and my fiancé send an email to the Vermont follow up on the 15th of March and now we had this email in return today.

The Privacy Act, 5 USC Sec. 552a, and Vermont Service Center policy prohibits release of information to someone other than the affected party. The affected party is typically the petitioner, applicant or attorney of record. Disclosures of processing times and general procedures relating to certain form types do not fall under the Privacy Act. However, information given to someone other than the affected party, such as the beneficiary, which relates to the specific processing or adjudication of a particular petition or application is prohibited by the Privacy Act and U.S. Citizenship and Immigration (USCIS) policy.

This is just ridiculous :angry: , it took them two week to answer this?? And this means that they won’t even give us any information in our case??

We have send mails before from his email account and we have had answer, but now we have this.

I got the same answer one time that I wrote to them, and we thought that I got this answer because I wasn’t the American citizen so he will have to make all the questions, but now even he has this type of answer.

Are there more ppl that have had this ridiculous answer???

Have you called the Customer Service Line for USCIS and asked for a higher level of customer service? Have your fiance do this, but even if action has been taken, I think USCIS waits to send out "bundles" of notices, they sure do like taking their time. Better times await you, the embassy in Santiago is very easy to work with! :)

Be sure that the petitioner sends in the request and in the request state specifically that you are the petitioner and have the right to know specific information about your petition. If you have both received back letters denying a response based upon privacy legislation, obviously one of them is wrong.

You could also contact your Senators' or Congressman's office, completing a privacy permission form, and asking them to investigate on your behalf. Provide them with the copies of the letters you received back to both of you denying a response based upon privacy concerns as obviously the one sent to the petitioner is wrong. Six months seems to be the magic number for a decision, though, so it may be that will be the answer you get back, however sometimes elected officials are able to get action on something that is truly delayed or misplaced.
