Hello everyone!

A friend of mine was divorced 3 times and he wants to know if he has to submit all 3 divorce decrees with the I-129F petition or just the most recent one. Also, would copies of the divorce decree(s) acceptable? Or they need to be original?

I would think the most recent one, it is to show that they are free to marry.

I remember reading that someone was asked to send all divorce decrees - but I'm not sure it was a request from the consulate or from USCIS.

Your friend can send copies, but have the originals kept for when/if there's need to show them.

According to Fiance & Marriage Visas, 3rd ed., "Any previous marriages must have ended by legal means - such as death, divorce or annulment - and you'll have to present the official doucments to prove it." While this may be open to interpretation, I took it to mean ALL divorces, not just the last one. I try to operate under the assumption that more documentation beats less. Thus I'd get documentation of all. The cost was under $25 and the wait was under a month. To me it was worth having this nailed down tight. But it's open to interpretation, and, of course, up to you.

I was previously divorced 2X, so I sent copies of the docs for both with the K-1 app. However, I got an RFE for the first divorce (long time ago), because what I sent for that one was not a copy of the final decree signed by the judge. Took me about a week to get a certified copy from the records archives in another state. I photocopied and sent it to NSC, who then approved the petition a few days later. That was a piece of cake compared to IMBRA, which has caused over a 4 month delay now.

Submit a copy of every single one at the I-129F. At the interview, have copies of every single one to leave with them and originals to show them. Apparently the fellow at the embassy liked feeling the impression left by the stamp on mine. (Poor guy!)

You will need to send only copies of all 3 divorce papers. But your fiancee will need all 3 CERTIFIED copies at his/her interview.

I got divorced twice and had sent in only the last divorce certificate with pur petition package. well, me not sending in the certificate from my first divorce, 19!!!!! years ago, has caused another delay on our process and CSC mailing us a second RFE. so you better send in all divorce certificates you have and if they are not in english so you need them translated and notarized by a certified translator.
